The Doctrine Of The Lesser Magistrate

Trewhella’s book, #5 on our Local Patriot's Required Reading List, is an absolute historical gem. Like truth itself, there's a strange power to freedom. Let's talk about that.

2) There is an ebb and flow to freedom's path. In 2020, freedom ebbed in America to its lowest tide in our history since 1776. Of all the countless factors causing this hellacious ebb, one rises highest, I believe. Education.

3) We have surrendered our children over to educations that are fundamentally opposed to freedom. I'll give you a quick example. My son Nico competed and won his spot in a science program for high school. He ended up in trouble for attitude. I attempted to defend him.

4) Attempted? Indeed. I attempted to discuss his "infractions" with the school principle. He refused to meet me. My head exploded. Here's what I discovered. The law stated, emphatically, that the moment I dropped my son off at school, his "legal" parent was the school.

5) By law, in dropping my son off at school, I legally forfeited all my parental rights. I surrendered those rights to the school itself. And the school had absolutely zero obligation to so much as consult with me regarding its decisions over my son while in their hold.

6) A technicality. Sometimes my son rode the school bus. He was MY son UNTIL he stepped onto the bus. Then, complete power over him resided in the school UNTIL he stepped off the school bus and walked the rest of the way home. The term for this is CUSTODY.

7) I have never been so shocked in all my life, never, as when I learned that I surrendered legal custody over my son the moment he stepped into a bus, or I dropped him off at school. I gave up all my parental rights. I don't think I'll ever quite get over that discovery.

8) He was 15 at the time. Today he's 36. I'm still not over that shock. But I believe I've come to understand it. This is how freedom ebbs. we give up freedom's rights and don't even know we did. I can't linger any longer. Don't let me get started on Teacher's Unions.

9) And here's Trewhella. As I have described, Trewhella is a very difficult read for me. He is a militant, protestant minister, and this comes through on every single page of his book. You'll find my introduction to Trewhella here:

10) The thing is, Trewhella's work helps me understand what happened to my son and me these couple of decades later. There were no lesser magistrates to cry foul upon such evil laws as gave custody of my son to his school, obliterating, while he was there, my custody over him.

11) There is an ancient doctrine, Trewhella teaches us, that demands justice be served by those below when those above trample upon it. When the greater magistrate causes evil to become law, it is the lesser magistrate who must rise to oppose it.

12) Let's return to Gene Sharp and his nonviolent overthrow of tyrannical dictators. He discusses at great length those institutions that patriotic and democratic republican constitutionalists must win over. There are institutions where freedom matters.

13) As I read Trewhella's work, my mind turns to our ministry. Be it Catholic priests who seek to save the lives of unborn children, or Protestant pastors who read of God's will in scripture, our ministry is an institution we must win over, completely.

14) Win over? Indeed. Win over to the Doctrine of the Lesser Magistrate. If Trewhella has a single greatest strength it is his ability to ground this doctrine scripturally while presenting it in its historic fullness. This doctrine is among the highest in freedom's history.

15) His book has 12 chapters. It is impossible for me to NOT imagine a pastor preaching at minimum 12 sermons on point. Every biblical and historic instance of this doctrine in action must be preached. Truth is, I think 48 such sermons are called for, 4 for each chapter.

16) When living up to this doctrine, there is a single local official, an Officer of the law, who's soul must be shored up. It is the local County Sheriff. Trewhella teaches us exactly what the lesser magistrate must do. He or she must stand in interposition. Let's dive down.

17) When the greater magistrate has imposed an evil law, the lesser magistrate must INTERPOSE him- or herself BETWEEN the power of the greater magistrate and those citizens who will be imposed upon, who's freedoms will be abridged. Interposition is their mandate.

18) When we read the Declaration of Independence, we find lesser magistrates prevailing upon their greater magistrate, King George III himself. Our entire existence as a free nation harkens to the principle, the Doctrine of the Lesser Magistrate.

19) Freedom does not come, in society, from "above," from those greater magistrates or government itself. Freedom comes from "below." It comes from free men and women who refuse to be over-lorded by their "betters." There are no kings in America.

20) If I were going to read one and ONLY one book from the list of 12, it would be Trewhella's book. Recently written, it harkens back to an ancient tone. Freedom, Trewhella tells us, comes from God, and from lesser magistrates who oppose the evil will of greater magistrates.

21) And sheriffs? They are the ultimate lesser magistrates. They swear an oath to protect and defend the Constitution, so help them God. They are elected, NOT appointed, and owe allegiance SOLELY to their voters. No other Law Enforcement Officer enjoys both.

22) Yet so few sheriffs realize the full extent of their power, their historic mandate, their mandate of interposition. In my new mission, I hope to reach all 3,083 sheriffs and ensure they know their role as constitutional magistrates, in all their power and duty.

23) I would likely have joined the Constitutional Sheriffs and Peace Officers of America association - the ONLY association I have ever joined - even if I had not read Trewhella's book. Having read it, there was no way I could resist joining.

25) I have commenced the project of coming to know my own local county's Office of the Sheriff and have begun to make friends with them. I live in a completely blue, Democrat county. No matter. Friendship works wherever you may be.

26) At some point, I don't know when, yet, I will provide copies of Trewhella's book to my sheriff's office. I will meet them. I will prevail upon them to support the Constitution and live up to their mandate. I even have a very, very specific tactical objective.

27) Tactically, President Trump has given us flawless guidance. There are just six requirements that must be established in every hamlet and locale in our land, for fair and free elections. Here they are...

28) Trewhella's book give us the spiritual, biblical, and historic basis of this critical doctrine. I'm not quite sure how we missed this before. Once you have his book, it will never be missed again. Do you have a preacher you respect? Buy two copies. One for you, one for him.

29) Unlike Trewhella, I am not a true believer. Yet, reading his book, all the belief I have is mustered. Perhaps one day I'll provide a skeptic's version, based on natural law as opposed to divine revelation. I only share that for honesty's account. I LOVE this book as is!

30) For America's sake, your state's and your county's sake, please buy, read, study, and share this book. If I have the pleasure and honor of meeting Trewhella himself this is what I'll say. Where are the 48 sermons your book requires? I want every preacher in America preaching.
