CJ Datta asks what is the patient population suffering from #Mucormycosis in Maharashtra and other states, what is the distribution of drugs. We cannot issue mandamus saying distribute so many drugs.

Chief Public Prosecutor DR Kale submits the data which was submitted by the Advocate General before the Principal Bench.

Court asks the amicus to make his submissions on the data provided.

He submits that the supply is less than 10,000 which is way shorter than the requirement.

He requests for permission to place on record a communication from a doctor in Aurangabad who says that 30% patients admitted do not have a chance due to under treatment.

He submits a media report which predicted the #mucormycosis in December 2020. Further there are only specific medications and no vaccinations.

Court asks ASG Talhar to respond to this respond to the report.
He points out the measures taken.

ASG: We have taken measures. There are also other drugs, alternate drugs available.

Justice RV Ghuge: This is like “locking the stables after horses have bolted”.

Chief PP: The number of patients seemed to have gone down. The supply is low, but the situation seems to be better.

Court: It is not as low. The number is in 1000. And the supply (of drugs) is no better!

Court dictates order:

Amicus has tendered press report by Loksatta and an article of December 19, 2020 which mentions about treatment, and risk factors for #mucormycosis.

Court: An order passed by the principal bench is placed before us. The statement made by ASG Anil Singh is recorded in para 9 onwards.
It indicates that an affidavit would be filed by the Central govt before principal seat and the matter is posted on June 21, 2021.

Court: Since the issue of #mucormycosis and drugs required therein is being considered by the principal bench, we are posting this matter to June 28, 2021.
In the meanwhile the Chief PP is directed to place before us an updated chart and the number of deaths occurred.
