Supreme Court hears a plea filed seeking directions for waiving the final examination of final year Post-graduate Medical Residents & constitution of a Joint Expert Committee for examining and recommending on their prayers #supremecourt
Sr Adv Sanjay Hegde: Prayers 2,3,4 are still pending. this is not adverse litigation. These students are on front line of covid.
Justice Shah: See second prayer which survives. How can they be promoted without exams?
Justice Banerjee: How can we pass a direction like this? You can’t be promoted without exams in this case
Hegde: But i can be considered notionally and service benefits be given
Justice Banerjee: we need not pass orders. universities are not even a party to this case
Hegde: i get so many SMS saying they are in bad place
Justice Banerjee: we have interfered and given relief. look at INICET exam. we gave relief as date was so soon. but here there are so many universities. how can we pass orders in this writ petition
Sr Adv Hegde: those exams are for people who are not into the profession
Justice Banerjee: they are for MD and MS students. they are all MBBS graduates
Hegde: our residency which would have ended is extended
Justice Banerjee: In India, gravity of pandemic situation is not going to be same. we today hardly have 100 to 200 new cases but in Karnataka there are larger number of cases. therefore this has to be decided locally depending on local conditions.
Justice Banerjee: National medical commission has given liberties to concerned universities. how can we pass general directions.
Hegde: at least a reasonable time for preparation can be directed
Justice Banerjee: how can we determine? Justice Shah can take 15 days for an exam, I can take 150 days
Justice Shah: sister, main naman karta hua
Justice Banerjee laughs
Justice Banerjee: universities are not a party here and no pleadings. in such circumstances, we do not deem it appropriate to pass any orders since universities are not a party here. NMC has given universities liberty the time and method of examination due to COVID19
Justice Banerjee: it is not possible for the court to say what reasonable time would be for preparation of exams. it is up to the commission and universities.
