#BombayHC bench of Justices Sambhaji Shinde and Nizamoodin Jamadar to shortly hear pleas filed by @SadhviPragya_MP, Lt Col. Shrikant Purohit n other accused in the #2008MalegaonBlast case seeking discharge from the case.

Adv Shrikant Shivade for Purohit. Special counsel Sandesh Patil for #NIA. Adv Nadeem Shaikh for victim Nisar Bilal and accused Sameer Kulkarni appears in person.

Bench seeks to know from Shivade as to how much time would he need to argue his case.

Shivade: certain documents have been made available after the lower court passed orders refusing to discharge my client. I pray that the matter be remitted back to the special court and a fresh hearing be held. Let the special court consider the fresh documents.

Patil for NIA: We have no objection if Purohit withdraws his appeal now. But if he prays this court to quash the discharge orders of the special court then we will argue it before your Lordships.

Or let him file a fresh discharge application before special court.

Shivade: They cannot infringe my right like this. Let the order be set aside by your lordship and then remit the matter back. Special court has said that it will consider these documents at the time of trial. It has said it would decide my challenge to sanction at the trial.

J Shinde: What is the stage of trial?

Patil: 181 witnesses have been examined. We had listed 400 plus witnesses but we will considerably reduce the numbers. Some witnesses would take time. Trial is going on day-to-day basis.

J Shinde: Okay, so we will hear on Monday.

Patil seeks more time than Monday as there are 'voluminous' documents in this case.

J Shinde: We will hear the matter on Monday at 2:30 pm.
