Bhati- Your Lordships me consider that a small amount of leverage because of the local condition.

Guruswamy- Our only issue is there has to be a minimum...
J Chandrachud- Are you in a position the rules notified are not in the interest of the consumer.
Guruswamy- I'll have to look at it State by State, and I would not like to say anything.
J Chandrachud- Or you can draft a minimum that is required.
(to Bhati) You framed the rules and many had their own rules, have you applied your mind that the State rules are contrary to the one you sent.
We'll say that those States who have not implimented shall implement now.
Bhati- We'll do that exercise of examining the rules of state has the essence of the rules framed by centre.
Guruswamy- There is a central advisory committee, can Niti Aayog not pursue it in a more formal way. They could examine it and then submit a formal report.
J Chandrachud- Ms Guruswamy you can examine this, we'll also ask Ms Bhati.
J Chandrachud- We'll just be back in 5 minutes.
Bhati- I have two suggestions, one is that we can do that exercise and other is that we can appoint Mr Bharuka as an Amicus.
Bhati- He can look into the issue individually, we had a word with him.
Order- Union of India through the Ministry of Housing and Urban affairs has filed the compilation of additional documents containing...rules under RERA.
Order- the Union Government has notified the Rules 2016 and the real estate, while the general rules and agreement rules are notified by various states, at the present state it is necessary for the court to be apprised that the rules adopted by the Central Government.
Order- Whether there are any deviation with the rules notified by the States. This exercise will be conducted at two level, the Union shall assess them with the rules, we also request Mr Baruka to assist this court as an Amicus.
