#Breaking: Texas CPS has ruled out child abuse in the case of the Briggles, one of three families under state investigation for allowing their trans child to access gender-affirming care.
Several other investigations into the families of transgender children remain active, @LambdaLegal lawyer states in court.
Some families were contacted just within last few days. #txlege
@LambdaLegal Judge asks state's attorney whether investigations into gender affirming care are unique in that CPS investigators were forced to pursue these cases?
State says it has no evidence to prove either way bc investigations were put on hold once suit filed. #txlege
@LambdaLegal Judge asks state's attorney whether investigations into gender affirming care are unique in that CPS investigators were asked not to put anything in writing?
State says it also has no evidence to prove either way. #txlege
@LambdaLegal State: "Giving hormones or pubertal blockers can constitute child abuse.”
Judge: "Is that true when the treatment is considered standard protocol and supported by every major medical organization in the United States?”
@LambdaLegal State says investigations into other two families in this new suit, pseudonym Roe and Voe, "are essentially at a standstill” because both have lawyers and aren’t cooperating.
@LambdaLegal Judge: “The evidence that’s been provided by the plaintiffs suggests that that prioritization is not allowed with respect to these allegations for treatment related to gender dysphoria.”
State: Investigations are not harm. We have not sought to remove any children. #txlege
State: There is no evidence DFPS is seeking to interfere with parent-child relationship.
Defends investigations into gender-affirming medical care. Says they must at least look into them. Reiterates no evidence of uniqueness of these probes. #txlege
Judge: Was the department investigating families under similar circumstances before this guidance on transgender care was released?
State: DFPS has always been able to investigate children being given medications.”
State: "To my understanding there was no report of that kind [regarding gender affirming care] prior to essentially when these cases began. And so there’s no history to point to.”
That is not true. DFPS investigated the Jeff Younger case and found no child abuse. #txlege
Judge: “You will concede there was no rule making in classifying treatment for gender dysphoria as child abuse?
Inbox: Like many other reporters, the city of Uvalde has declined to release to me records related to the Robb Elementary gunman and will take me to the @txag.
They hired a private firm, which has cited two full pages of exceptions to records laws to bar public release. #txlege
@TXAG I'm guessing Uvalde is sending the same form letter to everyone who's requesting information b/c I did not ask for anything that should necessitate the notification of a third party re: proprietary interests.
A lawyer for the plaintiffs who sued to halt the abuse investigations tells me this morning that they don’t think there’s any basis for Paxton’s appeal.
There isn’t a copy of the notice of appeal or an actual appeal brief online yet.
CPS has declined to answer our questions about how the pending litigation will affect their abuse investigations.
But if we take Paxton — who doesn’t lead @TexasDFPS — at his word, he’ll urge the agency to keep investigating trans kids as the appeals process continues. #txlege
