EU future relationship guidelines: thread

Tough & no big surprises: EU emphasise both N Ireland as outstanding issue a& Gibraltar in 1st para, reiterate previous guidelines from April & Dec 17 on integrity of single mkt, EU institutions & reference the EP’s 14/3 resolution 1.
EU want close relationship w UK on trade & security but emphasise the UK’s red lines mean it can’t be that deep a deal (so much for deep and ambitious from May) and that there will be negative impacts particularly for UK 2.
Emphasise the EU want a level-playing field with the UK underpinning any deal – if it gets that it will be prepared to be ‘ambitious’; yet again reiterates there is no cherry-picking of the single mkt, & the UK can’t have as close a deal outside the EU as in. 3.
V tough on level-playing field: “prevent unfair competitive advantage ...through undercutting of levels of protection with respect to, inter alia, competition and state aid, tax, social, environment and regulatory measures and practices.” 4.
EU want zero tariffs on goods along with reciprocal access to fishing waters; will be frictions & barriers at borders; v limited on services – look at providing services ‘according to host state rules’ emphasises UK will be a 3rd country 5.
Ambitious of movement of natural persons; plus want cooperation on transport ‘connectivity’ UK-EU after Brexit; UK can participate in research programmes – under 3rd country rules; 6.
EU want strong law and judicial cooperation; strong foreign policy & security cooperation – and strong safeguards in doing that on fundamental rights. Want strong rules on data protection, personal data to be governed by EU rules, no free lunches here. 7.
Governance of the future relationship will depend in part on its depth, mustn’t upset EU legal autonomy. Must meet EU requirements including on ECJ jurisprudence 8.
In summary, UK can have free trade agreemt, tariff free trade as long as access to waters; little access for services; non-tariff barriers will mean frictions at borders; N Ireland has to be solved; Gibraltar too; taking no hostages on level-playing field, UK deregulation risk 9.
