A few quick thoughts on the criminal referral to DOJ of Comey, Clinton, Lynch and others by 9 GOP Congress members

Second, I don't think this is designed to form the basis of a TRUE criminal referral. Why? The basis for the alleged charges are mostly news reporting, and don't directly connect to the individuals referred
Example: Hilary Clinton is personally referred for an alleged violation of 52 USC § 30121 (Foreign Nationals), but not exactly which part of that statue. Presumably it is receiving "something of value" (Section A.1.A) from Chris Steele - i.e. the Dossier.
But, the letter cites no evidence Hilary *personally* broke that statue, or that she received the dossier. Now, I happen to think she did, but that isn't provable in court based on public information - not yet. Marc Elias, Robby Mook or John Podesta on the other hand...
So if that's the case, what's this referral really for? A SHOT ACROSS THE BOW. To put in the mind of the public that indictments and investigations are coming against some of these individuals
Here is the exact timeline - which potentially implicates OBAMA directly. Yes, you read that right.
May 2 2016: Comey's Chief of Staff James Rybicki circulates the first draft of the Clinton exoneration email. Its a close hold, with only Andy McCabe (Deputy Director), James Baker (Chief Legal Counsel) on the distribution list
May 4 2016: Peter Strzok (running the Clinton investigation day to day, though McCabe is formally in charge) texts Lisa Page (Special Legal Counsel to Andy McCabe) saying "now the pressure really starts to finish MYE [Mid Year Exam; the Clinton email investigation codename]"
May 10 2016: Strzok texts Lisa Page again: "I cannot overstate to you the sense of urgency about wanting to logically and effectively conclude this investigation"
May 16 2016: James Comey and Loretta Lynch meet with President Obama at the White House, between around 9am-12am according to visitor logs. Oh sure, it's officially to award some medals, but watch what happens next... 
May 16 2016: At 3:07pm, Comey Chief of Staff Rybicki circulates the next draft of the exoneration email. This goes to a wider group, including Peter Strzok. CRITICAL: This is when they change "grossly negligent" (federal crime) to "extremely careless" (which is made up wording)
Also CRITICAL: This is when this group (Strzok/McCabe/Page/Rybicki and others) *remove a reference to Hilary Clinton emailing BARACK OBAMA WHILE IN RUSSIA FROM HER PERSONAL EMAIL SERVER*.
So, to recap: Comey and Lynch visit the White House and meet with Obama in the morning. Comey then probably has a discussion with his Chief of Staff, Rybicki. An hour or two later, THAT VERY AFTERNOON, Rybicki sends out the 2nd Clinton exoneration draft. Coincidence?
So at this point President Obama is now in the clear (the reference to "Obama" gets changed to "senior government official", and "Russia" to "Foreign Country", then both are removed entirely and never mentioned by Comey).
Obama will claim he only found out Clinton was using a non .gov email "from the news". Comey can't contradict this, or he'll have to explain why he didn't investigate Obama too. Obama will then deep six his emails with Clinton for about 25 years in his Pres Library - subtle
And of course Clinton is now in the clear too, once "gross negligence" is out of the statement. That's a federal crime: 18 USC § 793 (Section F) - "Gathering, transmitting or losing defense information", but being "extremely careless" is zero, home free: law.cornell.edu/uscode/text/18…
June 12 2016: Strzok texts Lisa Page to note A PROBLEM. The IC Inspector General (Charles McCollough) has discovered that some Clinton emails are marked (c), for Classified. The FBI "investigation" apparently missed this. Clinton will later claim she didn't know what (c) meant 🙄
McCollough was the guy who started the whole Clinton email investigation by the way, making the original criminal referral. He also led all of the Intelligence Community Inspectors General, across NSA/CIA/ etc. Major player.
June 13 2016: James Comey is at the White House with Obama again! This time it is to talk about the shooting in Orlando, Florida, and DEFINITELY NOT about what was discovered by the IC Inspector General a day or two before. Bet it wasn't even mentioned. Nope, nothing to see here.
IG McCollough is later threatened that he will one of "the first" to "be fired" in a Clinton administration. He retires after 26 years of service and later says publicly if he had done what Clinton did, he'd be "sitting in Leavenworth right now".
June 19 2016: AG Loretta Lynch says "The investigation into the State Department email MATTER is going to be handled like any other MATTER". Exactly mirroring the Clinton campaign language. Lynch had asked Comey to use "matter" as well in private, and he'd "reluctantly" agreed
June 27 2016: AG Loretta Lynch has her "chance" encounter with Bill Clinton on the airport tarmac in Arizona. Actually, Clinton had specifically delayed the take off of his plane. And expected the chat to be secret, no audit trail, no chance of ELINT interception either
July 1 2016: Lynch sort of "recuses" herself from the investigation after some patriot on that tarmac leaks the encounter with Bill Clinton. Says she'll accept @Comey recommendation on whether to charge Hilary Clinton
July 1 2016: Lisa Page sends text to Peter Strozk: “And yeah, it’s a real profile in couragw [sic], since [Lynch] knows no charges will be brought”. Of course, @Comey says he never discussed what his statement would be with Lynch, so how could she possibly know?
That bit is in the House GOP letter by the way. @Comey says under oath he made his decision not to recommend charging "after" interviewing Hilary Clinton
July 2 2016: FBI interviews Clinton for 3.5 hours (not recorded). Peter Strzok and David Laufman carry out the interview. The FBI let Clinton's aides who managed the email server for her sit in on the interview.
Did you notice something? Lisa Page is McCabe's Special Counsel. McCabe is in charge of the investigation & Deputy FBI Director, personally hand picked for promotion by @Comey - what is she doing texting the day before to Clinton's interviewer saying "no charges will be brought"?
July 5 2016: @Comey makes his statement exonerating Clinton and not mentioning Obama's role. He'd pretty much written this statement by May 16, so that's 7 weeks before interviewing Clinton herself, and over a dozen of her aides
July 19 2016: Comey and Lynch are at the White House again with Obama. This time its to discuss the shooting of officers in Dallas.
Anyway, back to the House GOP referral. Everything above is public information. The IG Horowitz has a LOT more, trust me. And so does Prosecutor John Huber
Congress could have included all of this and much more, if they were ready for this to be the time to nail Clinton, Lynch and Comey criminally. They're not, it's just to start the ball rolling in the mind of the public and force the MSM to cover it. The real fireworks are coming.

Sorry, forgot to mention that Andy McCabe has been fired and is facing criminal indictment shortly. Comey is fired. James Rybicki has quit. David Laufman has quit. Strzok, Page and Baker are co-operating with the IG and in a world of hurt
