who will make the biggest fool of themselves today — elmer woodard, a man who is somehow? an attorney licensed to practice in the state of virginia & represents a whole host of nazis, or mike enoch & richard spencer, who will be representing themselves?
stay tuned to find out!
emily gave us an idea of what to expect from today’s hearing in sines v kessler — several defendants have motions to dismiss today
they say a man who represents himself has a fool for a client... but a civil war relic who represents jason kessler is ALSO a fool with a fool for a client. the old adage did not prepare me for this situation.
(un?)fortunately, this isn’t one of the growing number of suits in which jason is representing himself. on tuesday in GDC:
judge: “do you want a grounds for defense? do you care about that?”
jason, obviously not knowing what that means: “uhhh yeah sure i’ll take it.”
i can’t imagine the federal court judge would amused by elmer yelling at me in the gallery while he’s supposed to be arguing a motion or calling emily to the stand just to ask her name... but i wouldn’t put it past him to try either or both again

phone’s gotta stay in the car today, so i’ll be going dark for a while... cracked open a fresh box of pens & a new notebook this morning. see you on the other side (or at lunch break, i guess!)
and we’re out! sadly elmer let kolenich handle their arguments today — he just sat quietly on a bench behind the counsel table in a wrinkled seersucker suit.
another counsel-related surprise! spencer got an attorney at the last minute and did not appear. his buddy greg conte accompanied john dinucci, a northern va attorney i don’t know anything about (yet)
IMAGINE being mike enoch and representing yourself pro se against roberta kaplan, the woman who argued & won US v windsor in front of the supreme court.
hell, imagine even being a real attorney up against that legal team.
enoch got so flustered during his argument that he accidentally (?) said he was talking to his “conspiracy team” (instead of security team) in the lead up to the rally.

kolenich & elmer represent 13 of the 25 defendants in sines v kessler: matt heimbach, matt parrott, TWP, identity evropa, vanguard america, cantwell, kessler, national socialist movement, nathan damigo, nationalist front, elliott kline, jeff schoep, and robert ‘azzmador’ ray
kolenich, from ohio, is not barred in virginia & is being sponsored pro hac vice by elmer. that seems to be elmer’s only contribution to this case, based on his performance today. he took a break from even being in the room during kaplan’s argument.
encouraging news about spencer’s new lawyer...
look, i’d never make a slanderous allegation about the man, but he was talking a mile a minute and seemed to have a cold or something.
he also appeared to have printed out the google results for all existing case law re: conspiracy & just read the titles. went well over his time.
oh dear, more bad news about spencer’s new lawyer 😂
rave reviews for spencer’s new lawyer, john dinucci
