Believe it or not, there is existing caselaw on mascot-related hot dog injuries. (1/)
In Coomer v. Kansas City Royals Baseball Corp., 437 S.W.3d 184 (2014), the Missouri Supreme Court ruled on whether the club could be held liable when mascot Sluggerrr hurled a hot dog at the eye of an unprepared fan, causing injury. Team argued it was an inherent risk at games.
The Court disagreed, holding unanimously that if Sluggerrr acted negligently -- if he did not exercise reasonable care -- the club could be held liable for injuries he caused. Why? Because hot dog tosses are not an inherent part of baseball games. scholar.google.com/scholar_case?c…
This is in contrary to injury from, as Dan Baker always says, thrown or batted balls and bats which may leave the field of play and enter the seating area. That's part of what fans knowingly sign up for.
When the case went back before a jury the next year, Sluggerrr was cleared after a two-day trial. kansascity.com/news/local/art…
