Isn't this also more an employment issue than a legal one? This came up with Franken, who I also thought should've resigned. "Due process" and "presumption of innocence" are important when talking about putting someone in jail. Here we're talking abt not putting someone on SCOTUS
Roy Moore and Al Franken weren't deprived of a natural right (their "freedom"). They lost Senate seats, which are obviously privileges that a rare number of people enjoy.
When a former teacher or coworker comments on your past performance, they aren't treated like witnesses at a trial. They don't testify under oath nor are their cross examined.
"When you said the applicant's articles were sloppily written and often missed deadlines, are you sure that's not a false memory? Are you certain you didn't *ask* the applicant to turn in the copy a week late? Did you send mixed signals."
