Lot of great takes on Glomar and police transparency under #FOIA / #FOIL in today's @NYCLU opinion, but I like the second half about bogus "trade secrets" exemptions even better
Even after finding NYPD invoked trade secrets wayyyyyyy too late, the Court went ahead to consider it on merits to make clear that pricing info is simply NOT a trade secret.
Particularly love this bit: NYPD's vendor whined that releasing pricing info would allow competitors "to undercut our prices." Welcome to the market, kiddos!
On Glomar, a nice couple zingers, too: "The only connection between protestors and terrorists appears to be that both groups use cell phones."
Opinion capped with a micro-treatise on why we have #FOIA / #FOIL in the first place: "FOIL is not about blind trust"

A regular reader suggested that I explain this. Instead I think I'll expand on it. Constitutional ponderings.
2. Our current Constitution worked, to some degree, for a long time.
As black Americans can tell you, it didn't work all that well for them. That said, the original, pre-amendment, pre-bill-of-rights, Constitution really wasn't about rights. It was a blueprint for a government.
3. I'm not sure this is widely appreciated. I see a lot of tweets that reference the Constitution in some way, but most of them go on to speak about something the Constitution never said or implied.
It's just a how-to manual.

NOTABLE: The lawyer who represented MANAFORT & GATES in their fight with @TheJusticeDepartment, Melissa Laurenza of @Akin_Gump, later fought MUELLER's efforts to compel her to testify against Manafort. Mueller continues pushing for access to her emails with Manafort.

a wonky thread about what it should mean for social media companies to be transparent. my last report to the @UNHumanRights Council discusses: freedex.org/a-human-rights… #transparency can be so vague as to be meaningless, so some [long] thoughts follow
let me just emphasize that i drew these principles from human rights law (& work of some great thinkers), not out of thin air. sure, that law applies to states, but companies also have responsibility not to interfere w/users' rights.
one aspect of transparency is clarity in the rules (community stds, guidelines, etc). they are broad and general, tho companies are trying to do better, it's true.
