JUST IN: Federal judge in New York rules Commerce Dept cannot insert citizenship question on 2020 Census, that in trying to add it, Sec. Ross violated the Administrative Procedure Act.
Judge Jesse Furman's opinion says Ross's stated rationale for asking about citizenship -- to better enforce the Voting Rights Act -- is not backed up by the record. Instead, Furman says Ross had an "anxious desire" to insert the Q for unknown, pretextual reasons.
Furman says those who brought this case have "proved" that a citizenship question in the 2020 Census would lead to an undercount of noncitizen and Hispanic households.
Specifically, Judge Furman says a citizenship question on the census would lead to a decline in self-responses by noncitizens by "at least 5.8%," an estimate he describes as "conservative."
DOJ spokeswoman Kelly Laco, responding to Furman's ruling, signals Trump admin will appeal:

"Our government is legally entitled to include a citizenship question on the census and people in the United States have a legal obligation to answer."
