Update re: Bijan Kian matter at the federal courthouse in VA - yesterday prosecutors filed a req. for 40 blank subpoenas or 20 sets (one for their party, one for the other) to be issued for trial. (Set for Feb 11) Who is being subpoenaed is unclear for now

One can assume these are witnesses - I look forward to finding out exactly who will testify. Stay tuned.
Also - a CIPA hearing is scheduled for Feb 8 at 2PM before Judge Trenga. What is a CIPA hearing? CIPA = Classified Information Procedures Act. This hearing gives attys a chance to sort out the relevance, use/admissibility of classified evidence to be used at trial.

Update: Kian req's a Sept. trial date. In addition to the massive amounts of evidence that must be prepared ahead of trial, he notes the gov't shutdown has "seriously hampered the normal process by which the govt would streamline defense preparation."

From the filing: "Given the uncertainty of when the government will be fully functioning again, there is no predicting when the defense will see core documents or know the challenges such late production will present, even if the production were to be provided tomorrow."
A status hearing to review CIPA evidence (or the classified information to be considered for trial) was set for Feb 8 in recent weeks. But that hearing should be delayed in light of the shutdown, Kian argues.

NEW: Update in the Bijan Kian/Ekim Alptekin matter at USDC EDVA - Judge Trenga has vacated the Feb 11 trial date. In light of voluminous records, including classified docs that must be obtained ahead of trial, the trial date is off the books, but other status hearings remain.

I wish everyone running context-and-analysis-free "OMG 70 blank subpoenas!" stories had one throat, and I had my hands around it.
FINE.

A trial subpoena orders a witness to come to court for trial. In many jurisdictions they are signed by both the attorney issuing them and the Clerk of the Court. /2
/3 In some places trial attorneys can get form subpoenas pre-signed by the clerk and just fill in the witness interview. In other places, apparently like the Eastern District of Virginia, you have to ask the Clerk of the Court for as many signed ones as you need for trial.

also to make sure every one understands - and i’m sorry if this is misleading in my tweet and/or story - 70 blank subpoenas = 35 sets. each set contains 1 subpoena for the witness and 1 for the defense counsel.
