Update: Kian req's a Sept. trial date. In addition to the massive amounts of evidence that must be prepared ahead of trial, he notes the gov't shutdown has "seriously hampered the normal process by which the govt would streamline defense preparation."

From the filing: "Given the uncertainty of when the government will be fully functioning again, there is no predicting when the defense will see core documents or know the challenges such late production will present, even if the production were to be provided tomorrow."

A status hearing to review CIPA evidence (or the classified information to be considered for trial) was set for Feb 8 in recent weeks. But that hearing should be delayed in light of the shutdown, Kian argues.

Kian writes: "The gov't will argue that the evidence is not relevant and should not be disclosed. But as a contingency, the gov't is seeking to update the security clearance of defense counsel so that counsel can be read into the classified material if appropriate...

"The process for clearing defense counsel will not even begin until the government shutdown ends," the motion states.

Also filed under seal in the Kian matter, an ex parte memorandum, which, according to this request, describes "additional investigations" the defendant wishes to pursue and could take months to conclude.
