UPDATE: Rep. Sheila Jackson Lee's office just put out a statement addressing allegations in a new lawsuit that she retaliated against a staffer who planned to sue the Congressional Black Caucus Foundation over an alleged rape by a former CBCF employee buzzfeednews.com/article/zoetil…
We also spoke today with a spox for the CBCF, who said any decision to fire a congressional staffer would be "outside the purview of the foundation." He said he didn't know if there were any comms between the CBCF and Jackson Lee's office about the allegations/possible lawsuit
The CBCF spox said they fired the former foundation employee accused of raping the plaintiff (she sued under a pseudonym, Jane Doe) after the woman reported the allegation. The spox said he wasn't privy to what the foundation uncovered in its investigation
Asked about the man's appearance at a 2017 CBCF conference, the spox said the CBCF didn't invite him, and third parties lined up panel speakers. The spox didn't know if anyone at the foundation knew the man was invited, and even if they had, might not have been able to bar him

NEW: A federal judge in Maryland has dismissed the state's lawsuit seeking to enforce the constitutionality of Obamacare as too speculative at this point — and, as a result, declared the challenge to Acting AG Matt Whitaker's appointment moot assets.documentcloud.org/documents/5717…
The judge found that notwithstanding Trump's rhetoric about the ACA, there isn't any concrete indication the admin will stop enforcing it now: "In effect, the State proclaims that the sky is falling. But, falling acorns, even several of them, do not amount to a falling sky"
And if the plaintiff (the state of Maryland) lacks standing to sue now, the judge wrote that any fight over whether Whitaker should be named in the lawsuit as the acting AG (which is a fight over whether his appointment was lawful) is moot

Roger Stone has entered the courthouse for his 2pm hearing. He's wearing a dark gray pinstriped suit, white shirt, dark tie, and a patterned pocket square. He greeted reporters, and said he didn't have plans now to speak after the hearing

JUST IN: The White House has announced Trump's nominees for the 9th Circuit and CA district courts — two 9th Circuit renominations from last year (Collins and Lee), but one new one: Daniel Bress. Patrick Bumatay, last year nom'd for the 9th, is now up for a district court seat
The other three district court nominees are renominations from last year (Blumenfeld, Rosen, Scarsi). On the California nominations last year, and how they were the White House's way of taking a jab at Feinstein and Harris: buzzfeednews.com/article/zoetil…
