State also led evidence for its 3rd witness Mr Nyamayaro who is stationed at the CID Headquarters. He has been in service for 19 years and is currently at the rank of Assistant Inspector as a qualified administrator. @BitiTendai

It was My Nyamayaro 's evidence that he received instructions from Ascom Nyabasa (State's 2nd witness) , to download a video form Youtube titled 'Hon Biti addresses the media'. He downloaded the video on a compact disc and transcribed the message.

Upon Cross Examination Mrs Mtetwa asked him if at any point he took the submitted CD and transcript to a court approved transcriber. Which he confirmed he did not. Mrs Mtetwa also asked the witness if @ any point what he transcribed made mention of the MDC

This is contra to what is placed before the court under the Charge sheet. Mrs Mtetwa also probed the witness how long was the video which he states was more than 20 min but the transcribed portion starts from 0:01-0:5:24.

Mrs Mtetwa further asks the witness why he only transcribed a portion of the full video and not all of it. Witness replies he was working under full instruction of Ascom Nyabasa who ordered him to transcribe that specific question.

Mrs Mtetwa made it known to the court, that the transcript in itself was selected in a way to frame a picture that puts @BitiTendai at the wrong side of the law & misleading the court.

The state's last witness Perfect Hlongwane from @ZiFMNews. He was present at the press conference in question at which the contentious statement was made. It was his evidence that he did not hear Mr Biti announcing results.

He stated that @BitiTendai only stated that from the collated information which came from ZEC 's official documents , @nelsonchamisa had won the election an awiating ZEC to make the announcement.

It was also the 4th witness's evidence that he posed a question to @BitiTendai that what would happen if ZEC was not going to announce the results as indicated on the V11 forms. @BitiTendai 's response was that would be impossible.

Mrs Mtetwa asked the witness if he considers @BitiTendai 's statement to have been an announcement of results. He vehemently denies so, stating that he covers election results in his work and when the announcement of results is being made:

The total number of votes and the numbers for each candidate along with the percentages are included. Which does not appear from the Transcript or from the whole press conference. State closed its case thereafter. @BitiTendai @ZLHRLawyers @DianaKawenda
