3/ While free speech “means that government has no power to restrict expression because of its message, its ideas, its subject matter, or its content,” (Ashcroft v ACLU) certain “well-defined and narrowly limited classes of speech” permit content-based restrictions on speech.

8/ A “thing of value” under § 875(d) likely includes intangible objectives. Numerous intangible objectives have been held to constitute things of value under a variety of other statutes, including even romantic pursuits and sex-related consideration!
