Rogow now saying Stone's Instagram post is separate from his pretrial release conditions, which could be modified if there was a "real threat" to a person in the community.
Stone now approaching the bench and taking an oath.
Roger Stone on the stand now: "I believe I abused the order for which I am sorry. I am kicking myself over my own stupidity. I offer no excuse for it, no justification. It was the outgrowth of a lapse in judgement."
Stone: "This was an egregious, stupid error for which I apologize again to the court."
Stone: "I can only say that I am sorry. It was a momentary lapse in judgement. Perhaps I speak too much, this is a stressful situation.”
Stone: "I have acute financial stress. My consulting business has dried up. I have exhausted my savings. I have been treated for the emotional stress. This is just a stupid lapse of judgement."
Stone tells Judge he is not very technologically proficient, then says he didn't "recognize it was crosshairs. I didn't even notice it until it was brought to my attention by a reporter."
Judge asks why Stone continued for next two days to speak about how he was treated unfairly after the apology document was filed with the court. Stone responds saying, "There was media distortion of my intent."
Stone now admits that he is the one that posted the image, not a volunteer. He admits he relies on volunteers for certain things, he's not technologically proficient. He says someone else selected the image, but he posted it.
Stone tells judge he thought the crosshairs symbol in his Instagram post was a "Celtic" sign that is tied to a cult, not the crosshairs for a gun.
Stone is now being cross-examined by prosecutor Jonathan Kravis from the US attorney's office in DC. Kravis continues to ask who selected the photo Stone posted. Stone says one of his 5-6 volunteers, he starts naming some but says "none of them will own up to it."
Kravis asks if Stone may still have image on his phone. Stone says he deleted all of them. Jackson asks: "You had a choice?" Stone replies yes that he chose the photo, but says "It was an error."
Stone: "I had no malicious intentions. I explained my lapse in judgement, This is a misinterpretation of my intention. It was just immediately assumed it was a crosshair. I didn't think it was."
Stone asked by his own attorney, Bruce S. Rogow, when he realized the Instagram was wrong: "After I got a text message from a Daily Mail reporter, asking about the crosshair."
Stone struggles to recall the names of his "five or six" volunteers who may have selected the photo — "My house has become a headquarters," he says. Judge Jackson chimes in, "I thought you only had five volunteers."
Prosecutor Jonathan Kravis from the US attorney's office in DC: This was an "attack on the integrity of this proceeding. The defendant continues to amplify that message in the press. That conduct is “a desire to manipulate media attention to get desirable media coverage.”
Kravis now asking for a "further restriction" on the "extrajudicial statements of the parties" — they want a stronger gag order on what Stone can say out of court. "The defendant's Testimony was not credible," he said.
Government Attorney Jonathan Kravis says the Instagram could "reasonably construed as a threatening image" that could taint the jury pool. They want further restrictions on Stone's ability to talk about the case.

IMPORTANT TO NOTE: The government did not ask Judge Amy Berman Jackson to revoke Roger Stone's pretrial release altogether. They are asking for a more restrictive gag order for Stone moving forward.
Judge Amy Berman Jackson is now taking a 15-minute break, she says she'll come back and announce a decision.

Judge Amy Berman Jackson: "I am not reassured by the defense that Stone is all talk and no action and this was just a big mistake."
Judge Amy Berman Jackson: "This was a deliberate action. Roger Stone could not even keep his story straight on the stand."
Judge Amy Berman Jackson: The post has a more sinister action... Roger Stone fully understands the power of words and symbols. There's nothing ambiguous about "crosshairs."
Jackson: "What concerns me is the fact that he chose to use his public platform and chose to express himself in a manner that can incite others that feel less constrained."
Judge Jackson to Roger Stone: "Thank you, but the apology rings quite hallow."
Jackson: "For all these reasons, if Stone is released under the current set of conditions, he does pose a danger to the public."
Judge Amy Berman Jackson: "No Mr. Stone, I'm not giving you another chance... the defendant may not speak publicly about the case. Period. He may not comment about the case indirectly."

BREAKING: Roger Stone is not allowed to speak publicly about his case after posting an offensive Instagram post.
Judge Amy Berman Jackson: "Today I gave you a second chance but this is not baseball, there will not be a third chance." Stone is still allowed to solicit funds for his legal defense and say he's innocent of the charges.
