Nadler just told @ChadPergram he's "not sure we won't" seek to assert Congress's "inherent contempt" power, which would, under the historic practice, see Barr hauled before the House to be punished by the body.
@ChadPergram That said, Nadler said it will "probably be a civil contempt," which means a lawsuit filed in federal court -- and not the first congressional effort in more than 80 years to jail a recalcitrant witness for contempt.

The first report of the D-Day invasion into CBS headquarters came over the AP wire. It cited a German press agency dispatch.

Ned Calmer broke into an orchestra broadcast originating from Hollywood at 12:48am:

"We are interrupting this program to bring you a special bulletin."
No one was answering at the CBS bureau in London, where it was about 6am.

But they were on the story.

At that early hour, Ed Murrow was among the American newsmen sequestered in the basement of Supreme Allied Headquarters, being briefed on what was happening.
At H-hour, Collingwood, Richard C. Hottelet, Larry Lesueur and Bill Downs were embedded with allied forces.

All of them were sworn to secrecy. No one at CBS in New York knew.

JUST IN: From a voicemail left with Flynn's lawyer by Trump attorney John Dowd, re: Flynn taking part in a joint-defense agreement w/Trump or striking a deal w/govt:

"Remember what we've always said about the president and his feelings toward Flynn, and that still remains..."
"I understand your situation," Dowd began, "but let me see if I can't state it in starker terms."

Dowd then warned Flynn's attorney of a "national security issue, or maybe a national security issue," if he had "information that implicates the president."
"So, uh, you know, then, you know, we need some kind of heads up," Dowd said on the voicemail to Flynn's lawyer.

"Just for the sake of protecting all our interests, if we can, without you having to give up any confidential information."

Now, some history.
Believe it or not, ABC's venerable FM flagship was born at 30 Rockefeller Plaza as the FM sister of Blue Network flagship, WJZ, which you know today as @77WABCradio.

(The stations moved to 66th St, then 1926 Broadway, then 1330 Ave of the Americas, and finally, 2 Penn Plaza.)

If they're not going to use inherent contempt powers – jailing Barr until he appears – they're wasting time
Inherent contempt was how Congress got things done for most of our history. But for whatever reason they stopped in the 1930s

The Fast & Furious litigation started when Eric Holder was Attorney General. By the time it ended, Jeff Sessions had that job. Relying on the courts here is stupid.

1. The prudence of impeaching the attorney general appears to be catching on. In the last 48 hours, two Democrats have floated the idea of indicting William Barr. Seth Moulton and Eric Swalwell are fairly minor figures (though each is running for president).
2. But new currents never start from the center. They begin at the margins. If more Democrats float impeachment, especially the leaders, we’ll know it’s coming.
3. As of now, the Democrats are moving forward step by painfully methodical step. Jerry Nadler, the chairman of the House Judiciary Committee, said yesterday that he’d give Barr one more chance to turn over the full and unredacted version of the Robert Mueller report.

Nadler is going after Barr.

He has no choice.
If a contempt request or a perjury referral is sought against Barr, a contemporaneous motion for appointment of a Special Prosecutor can be filed for that proceeding due to Barr’s conflicts of interests in pursuing criminal contempt and/or perjury case against himself.
For those frustrated w Nadler’s attempts to negotiate a resolution of this matter, under the contempt rules, it is required that both parties make a showing in the record that they exhausted all attempts to resolve the matter without contempt as a remedy.

1/ The mechanisms that Congress must use to enforce a subpoena or to sanction a party for contempt are time-consuming and cumbersome, with each escalating step in the process requiring a greater level of political commitment.
2/ For example, most committees’ rules authorize their subcommittees or chairpersons (occasionally in consultation with the ranking members) to issue subpoenas requesting documents or information.
