THREAD on @JohnWHuber INCREDIBLE THREAD. First, ready Huber's entire analysis. 🎼do do do do do do do dopdadopdadopdadop 🎼Okay, let's start with end that this shows either Steele lied or the FBI lied. Here is my only disagreement with Huber's brilliance: THEY. BOTH. LIED. 1/
2/ And Kavalec forward to FBI and it went to Strzok. Whether Strzok shared info with anyone else at FBI or the DOJ or the individuals who "verified" the FISA application is irrelevant. Under the law, given Strzok's role, him having the knowledge is the FBI having the knowledge.
3/ Remember Kavalec's note PROVED Steele was lying b/c she wasn't in FBI. And also included balancing needs of media! That means the FBI lied to the FISA court. We must get to the bottom of that and hold Strzok & others responsible accountable & that includes Steele!
4/ But it appears that the DOJ & FBI dropped Steele from their sites as of December 2018. thefederalist.com/2019/04/15/doj… If so, who made that decision? I'd wager it was Whitaker and I'll double-down on Barr revisiting the issue, especially with this added evidence.
5/ Second and related point: Wray's taken heat redacting Kavalec's memo, but as my in-process piece explains, as Rosenstein was the DOJ's white hat, Wray is the FBIs. Those redactions likely related to several investigations of Spygate players. We might just be putting this
6/ together, but that doesn't mean the white hats haven't been doing it for months. And third point: As Huber points out, Source E's bad intel on one point, means FBI shouldn't have relied on him on other points. This point is huge because it highlights the entire mess DOJ/FBI
7/ made of FISA process. An ABOLUTE abuse of the process & power of the government. @AndrewCMcCarthy first pointed out the problem: The FISA application relied on Steele's supposedly stellar reputation and his past performance as a credible source BUT Steele wasn't the source
8/ Steele was repeating what sub-sources and sub-sub-sources had told him. EVEN if Steele had had a record as a credible source, as McCarthy pointed out, Steele can't vouch for sub-sources, much less sub-sub-sources. AND legally when you have a source of unknown veracity
9/ and unknown reliability, courts require substantial independent police corroboration. We've long known the FBI didn't corroborate the sub sources, as I explained here @FDRLST thefederalist.com/2018/02/14/big… BUT now we know that State informed FBI that basic information was WRONG.
10/ So it wasn't merely that FBI didn't attempt to corroborate--it was worse! The FBI swore to a FISA application that included info from sources of unknown of reliability without attempting to corroborate the information, while having information that Source E was KNOWN
11/11 to be UNRELIABLE. AND you know what that means? That Steele, who vouched for the sub-sources, now also lacks reliability. END
