Whew! So many sleepless nights to respond to the governments pathetic counter to our Aadhaar writ petition. Seeking damages for breach of privacy. Our rejoinder came to 162 pages! To respond to each repetitive long winded point of the govt! Ironical that we call this a "Brief"!
1. All the government says in nearly 200 paras of theirs is that their "security" systems are "robust". And that breaches have not been proved. The same thing. Over and over again. Ad nauseam. And that the SC in Puttuswamy already decided the issue.
2. This, when the SC itself in Puttuswamy clearly makes a reference to my writ petition in the Delhi high court and says that they are leaving this issue open.
3. Our response is very simple. If you are contesting the breaches, surely you are open to an independent committee investigating the same. In our writ petition we've asked for an independent committee to investigate the breaches and ascertain the extent of damages.
4. Anyway, fingers crossed for tomorrow when the matter comes up. Well done to @IDIALaw team of Eshwar and Bhavya who worked really hard on this.
5. To repeat: our writ petition before the Delhi high court does not challenge the constitutionality of #aadhaar. It simply puts together all the public domain material on breaches and asks for an independent investigation to ascertain the scope of damage to privacy rights.
6. And demands damages for all these breaches. But first we as #aadhaar card holders have a "right to know" about the breaches. The UIDAI has been very evasive about the breaches and ties itself in knots each time it issues one of those duplicitous press releases!
