This @propublica story that DHS is using secret gang databases to justify separating families bolsters what we reported several weeks ago: that hundreds of parents are still being removed from their kids because of suspect claims that often fall apart

It includes Carlos, the Salvadoran dad we first reported on in Nov, who was accused of being MS-13 despite only one unsubstantiated piece of evidence the govnt refused to make public. He was released in May, with the govnt raising zero concerns of danger

These databases seem to sweep up people who were never charged with a crime at all, but perhaps may have been very loosely affiliated with gangs, as many in ES are because they control everything. Sometimes the accused migrants were in fact victims.

2/ Context: Asylum seekers in Tijuana and other border towns are being "metered" by an illegal system which requires them to take numbers on a list and wait their turn (sometimes months) to lawfully enter the US to seek asylum. This is already bad enough.

These #s appear to be the entire justification for the proclamation, and they badly need context. They may sound scary if you're new to the issue, but check out the overall historical picture & tell me this is a natl. emergency worthy of suspending a 4,000 year-old legal right

As a fmr immigration attorney let me be unambiguously clear. Crossing a boarder to claim asylum is *not* a crime; no under US or international law. Any child separated from a parent under that pretext is done so in direct contravention to the laws of the USA. ⚖ THREAD Pls RT.
If you came to the US without permission to apply for asylum, youmetjod of entry, whether legal or illegal *should* in no way effect your application process. Illegal entry is not a ground of inadmissibility for asylum applicants.
Unlike many other categories of applicants for immigration benefits, ppl seeking asylum in the US are not barred by having made an illegal entry; for example, sneaked across the U.S. border or overstaying a valid visa (one of the top ways people are in the country illegall).
