Would it be fair for a prosecutor to have a side job as a secret law clerk, acting as a judicial advisor to the same judges who heard his arguments in the courtroom? No, this isn’t a hypothetical scenario. This ethical violation happened in Clint Young’s Texas death penalty case.
The deputy district attorney assigned to oppose Clint Young’s post-conviction appeals for over 10 years was secretly getting paid by the court to draft orders, including in Clint’s case. The judges signed the orders with few or no changes, as if they actually wrote them.
The current district attorney handling Clint Young’s case only found out about this strange scenario by coincidence. The entire office has now been recused from the case because of this former deputy’s ethical violation.
An appointed special prosecutor will take over Clint Young’s case as a result of this serious ethical violation. There will be an investigation to determine what role this all played in the denial of Clint’s appeals while the prosecutor was also acting as a secret law clerk.
