Ok we’re back up and running. Lady Hale is restored.
But it’s ok she’s largely just recapping so far.
UNANIMOUS JUDGMENT.

Is it justiciable.

Wow.
The High Court was wrong.
This is not looking good for the govt.
It is justiciable.
The court says prorogation can be ruled unlawful if it parliament’s scrutiny function is upended.
Lady Hale says this “was NOT a normal prorogation.”
This is very, very bad for the government. Lady Hale just said this was a “suspension of parliamentary democracy.”
“The effect on our parliamentary democracy was extreme.”
Lady Hale is calmly and quietly destroying every claim every government minister (and the prime minister) have said about prorogation for the last month.
Hale: “the advice to HM Queen to advise the government to prorogue Parliament WAS unlawful.”
Lady Hale has just told this country that the Prime Minister, Boris Johnson advised the Queen to act unlawfully.

Just read that again.

And again.
The Supreme Court says that the “void and of no effect. Parliament has NOT been prorogued. This is the unanimous judgment of all eleven justices.”
The Supreme Court says Parliament can essentially meet again whenever it likes.
That could not have been worse for the government. Utter condemnation of Boris Johnson’s actions. Completely damning.
Boris Johnson will now face accusations that he misled the Queen.

In any other period, there is no question that would lead to a prime minister’s resignation.
I think a) the chances of Boris Johnson being able to “get around” the law have decreased and b) the pressure for a Vote of No Confidence must now go up enormously.
How can any MP decrying Johnson and what he’s done not vote against him in a VONC?
This is quietly damning: “Nowhere is there a hint that the PM, in giving advice to HM, is more than simply leader of the Government seeking to promote his own policies; he has a constitutional responsibility.” Ie he has completely neglected them.
