This bit of pompous alliteration actually hides an interesting point about AV Dicey (one of Rees Mogg’s heroes, and quoted here). H/t @JohnNemoBell for referring it to me.
Mogg quotes (I think slightly inaccurately, but no matter) this bit of Dicey’s 1915 Introduction to the Study of the Law of the Constitution. (oll.libertyfund.org/titles/dicey-i… is an online version).
He does not, however, quote this bit, just below. I wonder why not?
As background it is also worth noting Dicey’s discussion of referendums in this 1915 edition. He argues that they have a role (though he confines them to saying yes or no to a proposed Act of Parliament rather than to an open-ended one such as that if 2016).
But that was a handbrake turn from earlier editions. And the reason for the handbrake turn? Dicey’s visceral opposition to Home Rule for Ireland, the passage of which by Parliament caused him to revise his views on unfettered Parliamentary sovereignty.
