This opinion continues the line of cases that suggest mere Congressional oversight cannot peer into a grand jury room, but an "inquiry whose core aim is assessing possible articles of impeachment" can, and it's up to courts to police that line. (see also news.yahoo.com/in-pursuit-of-…)

Presentation aside, this is a perfect illustration of the continuing relevance of the inherent contempt power. No reason Congress should have to go plead to a coordinate branch to get subpoenas enforced in an impeachment inquiry, except that it has abandoned its rightful powers.

I don’t know if it’s all worth remembering, but at least remember that Kelly’s parting explanation of how family separations at the border happened was that Jeff Sessions sprung it on him as a surprise. vox.com/2018/12/30/181…
This was a lie, btw, but a revealing one. Kelly had announced consideration of the policy himself when he was DHS Secretary.

Good morning from US District Court in DC. At 10 am, House Judiciary Committee & DOJ lawyers will appear for a hearing in the Democrats’ lawsuit to get Robert Mueller’s grand jury materials as part of their impeachment inquiry. I’ll live tweet some of the proceedings.
There are no HJC members here but top Democratic aides for the panel are in the courtroom to observe the proeedings, including staff director Perry Apelbaum, Norm Eisen & Barry Berke.

Cont:

Context: It depends on what the meaning of 'impeachment process' is

On one hand, it could be politically unpopular for Dems to have a full House vote opening impeachment inquiry

OTOH, they want to strengthen their hand in court fights, and throw a bone to pro-impeachment base

House Judiciary Chair Nadler announced they're filing an application in the DC federal district court seeking grand jury material from Mueller's probe. Note the DC Circuit recently issued a decision that narrowed judges' authority to unseal grand jury info
Now, this DC Circuit case isn't totally on point — it involves a request for "historically significant" materials going back to the 1950s — but the notion that the bar is exceptionally high for courts to approve disclosure of grand jury material is relevant

1. It is important to remember Mueller acts as the Deep State Fix-It man. His worth to the DS is his ability to act as a wall between the facilitators, their nefarious actions, and the wheels of justice.

Barr made it perfectly clear in his testimony today that he is obdurate and will remain obdurate about handing over the grand jury materials that House Judiciary Committee chairman Jerry Nadler has requested. 1/62
Nadler has authorization from the committee to subpoena Barr for the materials, but he is waiting to see the redacted version of the MUELLER REPORT that Barr is preparing before he actually sends the subpoena. But clearly, Nadler is expecting the worst. 2/62
