Immigration advocates and attorneys say there is a troubling and apparently new trend of US officials going out of their way, including issuing fake court date notices, in order to keep even those who have been granted asylum out of the country.
On Monday, CBP commissioner Mark Morgan said this should not be happening.
But a CBP spox confirmed the maneuver, saying that when a decision is appealed, “immigration proceedings remain underway and individuals enrolled in MPP can be returned to Mexico to await the appeal.”

We included a copy of the court notice given to Francisco when he tried to enter the country.
The notice says a judge has scheduled a hearing but I tried calling the DOJ number listed & was told that there is, in fact, no hearing scheduled.
That makes sense - he won his case.
