The EQUAL OPPORTUNITIES MONITORING FORM in your job application appears to have a list of the protected characteristics under the Equality Act 2010 and it correctly includes 'sex'.

It then asks, "Would you describe yourself as:" and includes the options, 'Female', 'Male' and 'Other'.

Sex is the protected characteristic under the Equality Act 2010 & is an innate and immutable characteristic of a person and not something that can be 'described': it is either 'Female' or 'Male' as defined in the Act & consistent with biology. 'Other' is not a valid option.

It then asks, "Does your gender identity match the sex registered at your birth?"

'Gender identity' is not a protected characteristic under the Equality Act 2010 and is not defined in the Act.

Asking about a personal characteristic such as 'gender identity' that is not a protected characteristic under the Act, may be in breach of the GDPR by processing personal data without a lawful basis.

Language and meaning of words are important and proper use & understanding of terms is vital so that the public is aware of what rights they have and what your duties are. Any confusion or inconsistency over meaning may prevent people from accessing their rights in law.

Sex is an innate and immutable characteristic of a person and not something that can be 'best described': it is either 'Female' or 'Male' as defined in the Equality Act 2010 and consistent with biology. 'Other' is not a valid option.

Intersex is not protected characteristic under the Act nor is it defined in the Act. However, it is also not a sex class and those with a Difference of Sex Development are still considered to be of the male or female sex class.

A brief explanation of the technicalities of the #MayaForstater case and what the Judgment was about and what it was not about.

MF engaged in discussions regarding reform to the U.K. Gender Recognition Act about which a public consultation was underway.
She expressed, on Twitter, her beliefs that sex cannot change apart from in the legal sense and that sex matters to women’s rights.

She did so on her private account and spoke in general terms.
She did not misgender or dead-name anyone who had the protected characteristic of gender reassignment.

Her contract was not renewed.

And the issue of context of communication. If to be hate incident must be hostility. It is clear that communication can be by victim or any other person. EG disabled adult comes off bus, arrives at day centre and tells staff of incident of abuse. #FairCopJR

Latest blog from the Chair of the Working Group on data on sex and gender. The Chief Statistician states "What is clear is that there isn’t a standard way that data about sex and gender is being collected, either in Scotland or the UK". blogs.gov.scot/statistics/201…
This lack of consistency is reflected in other policies. Public organisations routinely muddle sex & gender, misinterpreting equalities legislation. Earlier today we highlighted this example from the just published Cashback for Communities Programme EQIA:
This @mbmpolicy blog shows how only *seven* out of Scotland's 32 local authorities consistently listed ‘sex’ as the protected characteristic in their policies.

Musing further on the sex/gender debate around the integrity of the definitions of protected characteristics in the Equality Act 2010. Don't know if I'm right, so def. open for challenge but please do so on legal basis, not emotive slogans 1/
Currently the protected characteristics are reasonably well defined. So to enforce right in ET or court not to be discriminated against on grounds of "disability" you have to satisfy, with evidence, test in section 6 (or prove you have condition which is deemed as disability)2/
For GR, evidence (generally witness statement in ET) that satisfy s7 "person is proposing to undergo, is undergoing or has undergone a process (or part of a process) for the purpose of reassigning the person's sex by changing physiological or other attributes of sex."3/

Things which are not #transphobic, despite TRAs shouting otherwise:

- safeguarding children and vulnerable adults
- homosexuality
- heterosexuality
- women’s rights
- science
- evidence-based healthcare
- asking questions
- women saying ‘no’ to men
Sex, race, religion, sexual orientation: all are protected characteristics under the Equality Act 2010. Gender identity is not. Gender reassignment is not the winning card in a game of top trumps. Every protected characteristic must be considered when changing policy or law.
Women, men, genuine sufferers of gender dysphoria: Your rights, safety, privacy and dignity and those of your children and elderly parents are under threat by a bunch of self-entitled men yelling ‘transphobe’ at you. You are allowed to say no.
