This drives me nuttier than almost anything in legal culture: Everyone telling you how non-partisan and consistent they are, and it's those bad guys over there who are hacks.
John Roberts talking about balls and strikes is a perfect example. But it's judgment calls all the way down! We can all try to be fair-minded and consistent but there's no, like, special outer realm of Real Objectivity that some special coterie of people exist in.
The entire Scalia framework of originalism is, in my humble, and admittedly amateur opinion, largely a means of getting the outcomes you want by invocation of this putatively objective Standard. But no one will cop to it.
