It also seems deeply cynical to me to credit Barr’s version of events—which asks us to believe four seasoned prosecutors withdrew and one quit the department over a miscommunication. A dilemma.
Here you have Bill Barr saying very few in DOJ disagree with taking the position in court that a guidelines sentence is inappropriate and very excessive, with all the impacts that could have on other cases. It’s cynical to give credence to that. abcnews.go.com/Politics/trans…

An amazing load of hooey. Does Kim Strassel know the sentencing guidelines exist? Does she know what they’re for? Do her editors lack the gene that allows human beings to experience shame?
It’s not original to observe that media institutions like wsj use their megaphones and the credibility of their reporters to promote voices of profound ignorance like Kim Strassel. It just sucks and it might cost us the republic.
For those who don’t know, the federal sentencing guidelines are a formula—an elaborate one—intended to promote uniformity in sentencing across the country. The Stone prosecutors calculated the 7-9y using that formula and recommended the judge follow it.

You gotta look closely here, but it appears NYT has determined that DOJ spokesperson Kerri Kupec’s claim—that the decision to override the sentencing rec was made before the president’s tweet—is untrue.
Correx: They’re saying whenever the decision was made, the intervention itself occurred hours after Trump’s tweet.

Let's be clear here, this is what is going on with Barr.
1. As a matter of law, Barr cannot provide Congress with the grand jury information that Democrats just held him in contempt for not turning over to them.
2. Barr can, however, petition the courts to allow release, and the House Democrats have requested he do so. He refused, and this adds to their reasons for the contempt vote. Important to note, he is not required by law to accommodate their request to petition the court.
3. Democrats additionally feel his no-show for their hearing last week adds to their contempt charge. However, they had demanded, against normal order, that he be questioned by two prosecutors. Je did not agree but offered to teach an amicable arrangement.
