Just to note that @michaelgove’s vague statement that “it is not the case that the CJEU should be governing the application of state aid in the way some have envisaged” isn’t even a denial of, let alone a refutation of, what I said here. threadreaderapp.com/thread/1194996…
It isn’t a denial of what I have said because he is entirely vague about whose views he is denying. (And NB my views are pretty widely shared, as I point out here uksala.org/paper-by-james….)
And it isn’t a refutation because he gives no reasons at all to suppose that I and others who agree with me have got this wrong.
@StevePeers also makes this excellent point about the false premise underlying Duncan Smith’s question.
