1/5 Important thread by @PawelZerka on the domestic dimension of the #RuleOfLaw debate in #Poland.
To be honest, I feel optimistic & reassured if the hurdles are so low.
The second and the third point are only face saving measures...
2/5 ... not real conditions, and they don't require any substantial concessions.
In case of the government declaration much depends on the content. However, if the #Polish government can be satisfied by emphasizing the tie between the #RoL conditionality instrument and ...
3/5 ... the EU's financial interest, which is given anyhow, then this isn't going to be the most difficult deal of the year.
Of course much depends from Hungary, but separating #Poland from #Hungary could be one of the most important results of the #EUCO.
4/5 IMHO, it's not a tragedy, if a breakthrough is only reached in January. MFF & #NextGenEU are anyhow in delay. It is important to preserve the unity & determination of the #EU25 and raise the pressure on 🇭🇺& 🇵🇱 by the #intergovernmental#coronarecovery package.
5/5 If that's given, the #EU25 will succeed.
A fast but bad deal at #EUCO this week is a bigger threat to the #EU than some further delay.

According to the plan, an #EUCO declaration will explain/limit the scope of the #RuleofLaw conditionality regulation as well as the timeframe of its application. The deal was allegedly sealed by #Orban & #Morawiecki Tuesday evening. @RULEOFLAWpl rmf24.pl/newsamp-kompro…

Apparently #EUCO is ready to declare that member states will refrain from the application of the regulation in the Council as long as #CJEU is not ruling about the action for annulment case which will be brought forward against the regulation by 🇵🇱& 🇭🇺. @PiotrBuras1
The #Article7 procedure is widely perceived as a completely failed, dysfunctional legal tool to enforce compliance with #EUvalues.
2/11
Therefore many see the closure of the ongoing procedures against #Hungary & #Poland as potential bargaining chips that may convince the EU's two autocratizing member states to withdraw from the blockade of the EUR 1800 bn budget deal @EU2020DE@MKarnitschnig@meyer_resende
3/11 @ManfredWeber hinted on that option last week and rumours from @EU2020DE confirm the intention of the German Council presidency to please Warsaw and Budapest that way. standaard.be/cnt/dmf2020112…
