Mazzocco's lawyer complains that "some reporter" (definitely not this one) published a screen shot from his initial appearance.
Judge Chutkan: The written submissions were not filed under seal. You can't seal without permission of the court.
Judge Chutkan: I'm going to unseal the documents. But I'm going to give you a week to file a memo. The public has a right to access these documents, especially in these case.

Judge Chutkan: I'm not going to give the names of Mr. Mazzocco's supporters because his lawyer wants to keep them confidential.

Judge Chutkan: The government is recommending three months of home detention?
Assistant US Attorney: Three months home confinement and community service. This is different from holding up a sign in a hearing. It is difficult to fathom a more serious offense.
AUSA: Each person who entered the Capitol made it more difficult for the authorities to regain control. Probation cannot become the norm.
[Why they did DOJ offer these misdemeanor plea offers? This is opportunistic revisionism, one wag might say] -Wag
AUSA: It was globally observed. Not just because of the news media. The rioters took pictures of themselves and uploaded them. They walked away and went home.
AUSA: Several judges of this Court have said probation should not be the norm.
[A dig at Judge McFadden? Will DOJ's plea offers change? Or is this just a split the DDC District Judges into two camps?
AUSA: He knew that those inside would try to overrun the police and stop our democracy. His comments gave false info about violence- but they were belied by his "The Capitol is ours."
Judge Chutkan: I have a question. Where's the camera footage?
AUSA: Don't know.
Mazzocco's lawyer: He's nervous, I'm going to read his letter. He writes, My decision to enter the Capitol was impulsive. It was out of curiosity. I had no intention of harming anyone. Later I saw the videos of violence and was horrified. I support the police.
Mazzocco through lawyer: I took part in something that played a humongous role in dividing the USA. I get threats by phone. I wish I hadn't traveled to DC. You won't see me getting into trouble again. I am focused on being a better professional [mortgage broker]
Mazzocco's lawyer: His house was in the news and people said, let's storm it. The fall out was massive for him. As well it should be for everyone that acted with disregard for democracy that day [! - a defense lawyer saying storming her client's home is right?]
Mazzocco's lawyer: Eighteen months probation and community service would be enough. It was 12 minutes in a lifetime of a million minutes. He took loads of supplies to Houston when there were hurricanes.
Mazzocco: My letter was from the bottom of my heart. It has taken a toll on me. I know that I made a big mistake. I would like to apologize to the country.
Judge Chutkan: Sentencing is difficult. Some have compared the George Floyd protests to this- I reject that
Judge Chutkan: The action of Jan 6 were watched with horror by people all over the world. In this Court's opinion the treatment of the rioters are been far more lenient - they were allowed to leave the scene of the crime
Judge Chutkan: Because of this COVID pandemic he has not even had to come to court. Courts play no role in charging or plea decisions. He did not break doors does not mean his actions weren't serious. I received letters saying it was impulse. That was not the case
Judge Chutkan: He flew from Texas to interfere with the certification of the election. Seeing the chaos, he decided to go inside. He took pictures of himself grinning as if the chaos swirling around him was entertainment. He bragged about it.
Judge Chutkan: He want there to support ONE MAN, not in support of our country. He stayed in for 12 minutes. Granted he did not destroy property, he told others not to. But he was proud of it.
Judge Chutkan: He claimed the violence was caused by Antifa, orgs that weren't even there. He was wearing a body worn camera but the footage has never been found.
[DDC / DOJ only selectively releasing videos like in US v. Padilla despite formal written requests]
Judge Chutkan: His remorse only came when he realized he could go to jail. The country is watching. This has never happened before... I'm a former public defender. Some violent criminals are beloved too. And they didn't have the resources of Mr. Mazzocco.
Judge Churkan: None of this made any different to Mr. Mazzocco's decision to come to the Capitol on January 16 [sic]. Probation would not protect the public, nor deter anyone.
[Note: sentencing now depends on which DDC judge the defendant's case is wheeled out to]
Judge Chutkan: I'm going to order incarceration. 45 days of incarceration.
Judge Chutkan: Then 60 hours of community service.
