OK - now back to #RittenhouseTrial closing arguments. ADA Binger: I have no doubt that the defendant had no idea what his weapon could do, he did not even look into it. Inner City Press has covered matthewrussellleeicp.substack.com/p/in-rittenhou… and will live tweet, below
ADA Binger: The defendant had fired at Jump Kick Man and miraculously did not kill him. Is it reasonable for a criminal to be able to shoot him way out of a crime scene? Could a bank robber do this?
[On the screen: "The Defendant caused the whole incident."]
ADA Binger: Full metal jacket ammo and pierce body armor and squad cars. It can travel five and a half football fields... We showed video of Drew Hernandez, who said he felt as risk here in little old Kenosha
ADA Binger: Let me tell you about Joseph Rosenbaum. He just stumbles into it. He tipped over a Porta-Potty that had no one in it. He lit a dumpster on fire... He said the N-word [heavy sarcasm in prosecutor's voice]
Now Rittenhouse's closing, by Mark Richards: Mr. Binger says I'm blaming the victim. But Mr. Rosenbaum was shot because he was chasing my client and trying to grab his gun. He was on a horizontal plane, leaping and lunging at my client.
Rittenhouse's lawyer Richards: Let's talk about Jump Kick Man. Look where his foot goes, how the kick in the face makes Kyle spin 180 degrees. They say, He shot somehow. They don't know he was attacked by a crazy person.
Rittenhouse's lawyer Richards: Mr. Grosskreutz has ten million reasons to lie... They have the burden of proof, we don't. Kyle was a 17 year old kid out there trying to help this community.
Rittenhouse's lawyer Richards: My client is no longer charged as a minor possessing a firearm.
[Judge dropped Court 6, possession of a dangerous weapon by a person under 18]
Rittenhouse's lawyer Richards: My client had as much right as anyone else to be in downtown Kenosha that night. As much as the rioters. Mr. Rosenbaum was going to ambush him. [Sips water]. The only thing I can say about James Armstrong is, OK, that's interesting
Rittenhouse's lawyer Richards: In this community, people have been found to have used self defense having shot seven times. My client fired only four times, in a short period of time. Let me show you what four feet is. From the end of the jury box to my foot, here
Rittenhouse's lawyer Richards: Why was Mr. Rosenbaum lunging at my client? Was he offering him the keys to the city? No. Soot only goes so far. If my client wanted to be an active shooter, why did he give Nick his body armor?
Rittenhouse's lawyer RIchards: Mr. Binger must live in fairy tale land to think that my client could just put down his gun and say, Everything is good.
Rittenhouse's lawyer Richards: We ask you to find our client not guilty.
Judge Schroeder: Let's take a ten minute break.
In midst of #RittenhouseTrial rebuttal summation, Judge Schroeder asks the jurors to step out.
Judge: Why would she have any testimonial privilege?
Richards: They can't piecemeal the charges. This is ridiculous.
Judge: Let's have it read back.
Court reporter: He said "they have a Fifth Amendment right."
Judge: I'll sustain the objection. Ask the jurors to come back in.
Then ADA Krauss limits the privilege --
Richards: Objection!
Judge: Please step into the library again.
Richards: They hold the key.
Now in #RittenhouseTrial ADA Krauss cites a "gossip blogger" who is pro-Rittenhouse, throws in Drew Hernandez. Uses the phrase "chaos tourist" for Rittenhouse. Krauss is checking off bullet points on his legal pad. Hollow point bullet points? #RebuttalAsGarbageTime
Judge Schroeder: Jurors, the case is now yours. You will disregard the claims or opinions of the news media and any social media, and the opinions of the President of the US and of the president before him.
Judge Schoeder: Tomorrow at 9 we'll pick the six who will not be on the jury, but they will still stay in the building in case their services are needed. Do not read about the case.

force a refresh
OK - now US v. Steve Bannon, arraignment and return on arrest warrant before DDC Magistrate Robin Meriweather. Inner City Press will live tweet, thread below
Judge Meriweather: You are charged with contempt of Congress, you could face one year in prison. Also 2 USC 192 violation... You have the right to remain silent, and the right to a speedy and public jury trial.
Bannon's lawyer: Under Rule 58b3, there can't been an arraignment before a Magistrate unless the defendant also consents to trial before a Magistrate. To be clear, we are not waiving.
Judge Meriweather: This is a misdemeanor, I do these arraignments all the time
Judge Nathan: My chambers sent both sides a list of 13 additional prospective jurors that should be consider for excusing. I understand the defense objected to striking four of them. So we'll keep them on the list, to proceed to voir dire.
Judge Nathan: Subtracting those out, we'd exclude 23, 114, 215 257... 561. Also, number 92. The two new ones that the defense wants to object are 226 and 404. We'll remove those two out of the agreed to list. So we have 231 jurors we agree should be called back.
OK - now Jan 6 case of US v. (mortgage broker) Matthew MAZZOCCO, he is up for sentencing by Judge Tanya S. Chutkan, to picketing or parading in the Capitol. Inner City Press has covered the case innercitypress.com/ddc15ainsurrec… and will live tweet, thread below
Mazzocco's lawyer complains that "some reporter" (definitely not this one) published a screen shot from his initial appearance.
Judge Chutkan: The written submissions were not filed under seal. You can't seal without permission of the court.
Judge Chutkan: I'm going to unseal the documents. But I'm going to give you a week to file a memo. The public has a right to access these documents, especially in these case.
[So what about the US v. Padilla video before Judge Bates, requested Sept 22?]
OK - now in Taliban support trial of Hossain, Day 3, cooperating witness Suhail is on cross examination innercitypress.com/sdnytrial3tali… Inner City Press is not being allowed to see but can hear and will live tweet, thread below
Federal Defender Dalack: This is a message from Delowar [Hossain] to me, on the day he met you in the mosque in The Bronx?
Long interpretation. FD asks to show it to jurors.
Suhair: This is the 2nd mosque.
FD Dalack: Let me take a step back. Based on your direct
AUSA: Objection. Misstates the testimony.
Judge Stein: What day was it? Was it the first day you met the defendant? April 20, 2018?
Suhail: I believe it was a different day.
FD Dalack: You went to the mosque looking for someone at the request of the FBI, correct?
Now @AmbMKimani says UNSC will go on junket to Niger (no UN mission there) and Mali (failing mission); he quotes an unnamed Ambassador at breakfast this morning trying to "touch reality." The reality at the UN today is censorship
Now @AmbMKimani says "UNSC is expected to negotiate a resolution for the mission for a Referendum in #WesternSahara." The UN has been supposed to hold that referendum for decades and never did, took money, had sex abusers running MINURSO innercitypress.com/unguterres2rew…
OK - Jan 6 guilty plea before DDC Chief Judge Howell in US v. Croy running into trouble - Croy says he didn't realize it was not authorized to enter. "I didn't see any signs." Inner City Press will live tweet - thread below
Judge Howell: You were on the Capitol steps for an hour, correct? [In the manner of cross-examination]
Croy: I was not on the steps for an hour.
Judge Howell: You're saying here today, under oath, you didn't know you weren't supposed to be there?
Croy: No sign.
Judge Howell: Did the police say anything?
Croy: They were shooting pepper spray and balls.
Judge Howell: That didn't give you a clue it was no OK to be there?
Defense lawyer: He just said that.
[Not really]
