Evidence is only now being presented. There was nothing offered prior to court during discovery, violating due process. A 22 min video is only now available to view.
“This is trial by ambush”- @objkshn asks for dismissal
Singer’s not prepared to rule.

.@objkshn asks for dismissal
🔥🔥🔥
Court recesses to consider
4/
During recess @objkshn requests to view video. @sandiegopd officer refuses pending Singer’s ruling
Clerk orders him to make it available during recess.
5/
Back in session. Impeaching evidence was viewed in video: Officer told defendant she was stopped for turn signal violation not window tinting.
Tint was not visible to officer until after stop. He did not use a light to measure tinting density
And dismissal under constitutional and other grounds. Singer reviewing timeliness of evidence being provided and penal code requirements
Court is restrained by these codes re granting request.
Not looking promising for dismissal
7/
.@objkshn points out the court is placing undue burden on a pro bono attorney subjecting her to work for free when the prosecution hasn’t made an effort to provide evidence. Asking her to continue Filing & preparing motions is an unfair burden to protect constitutional rights
8/
Side note: there’s a lot at stake here re people’s right to fair trial. @objkshn is under tremendous time/economic stress to defend basic rights while #sdcityattorney has failed to meet their obligations
9/
Singer: This case is from April 2022. He offers a continuance but not dismissal
His job is “to follow the law…not suggesting your frustration is misplaced”
(Justice delayed is Justice denied)
@objkshn asks for continuance to Jan 18 after conferring w/client-clerk checks
10/
Calendar 📅 discussion- case trailed. Court retains jurisdiction since sworn testimony has been provided.
@objkshn notes the Right to speedy trial being waived makes it less likely City Attorney will do her job and provide evidence in the future
11/
Starting back in new courtroom. Waiting for remote access but judge states “court is not under an obligation to provide remote access”
#sandiegoPD officer begins to testify. @objkshn notes he is reading from documents and requests copies of the report/ticket officer is using
Recess while copies are made
Case dismissed due to lack of officer requesting identification
I’m not needed to testify as a witness re Midway encampment sweeps and encroachment citations
These sweeps don’t provide #housing or support.
14/
To summarize this morning’s activities: the #sandiego police failed to do their jobs to provide evidence, and identify an unsheltered person before issuing an encroachment citation
As a result of their incompetence one case was dismissed, and another was continued. But…
14/
They were still paid a minimum of four hours to appear in court, even when the case was dismissed.
These encroachment citations are costly- not only for impoverished people being cited but also for taxpayers footing the bill for incompetent police & City Attorney work.
15/
Why is @MayorToddGloria continuing these policies of sweeps, citations, and harassment, when there is no housing for people to move into?
Maybe they are counting on poor unsheltered people having no defense- Because if they did, every case would likely be dismissed
16/
The real lesson today: This is an abuse of our criminal justice system.
So next time you call for police and they don’t arrive for hours: Thank @ToddGloria@ChiefNisleit & City Attorney Mara Elliott for wasting their time in court & your money paying for these cases that should never go to trial & are likely to be dismissed due to incompetence

Several months ago a request to modify a downtown redevelopment agreement & remove installation of a "Portland Loo" restroom was pulled from a @SDCityCouncil hearing
Does anyone know what has happened to this project since then?
1/
Public restrooms are desperately needed throughout #SanDiego for people of all ages, housing status & ability levels
The current model (i.e.- only customers have access to restrooms, via hotels, stores, restaurants, coffee shops, etc.) impacts #publichealth & transit use 2/
A @SDSU study also determined the lack of public restrooms is a #publichealth issue
Not sure who needs to hear this, but:
On July 11 #SanDiego will host a #Pride march and
the theme is #Resiliency
Related: I've learned a person who harassed/threatened me in 2019- until a court issued a restraining order against him- will likely be part of this event.
1/x
It's "likely" because he's been hired by an LGBTQ advocacy organization
Their Exec Director was not aware he's had 3 restraining orders in the last 15 yrs: One for harassment, two for #domesticviolence
I often relive this abuse & harassment since it happened in my home
2/x
I had wanted to attend the march w/friends- But the more I thought of being in public, surrounded by others who have been traumatized in recent years, the less appealing it became.
As a survivor: It's hard feel safe or be "resilient" when an abuser is marching with me.

Please RSVP and ask some questions about that #SDGE 20 year franchise contract negotiation, in light of the other contracts that have been completed recently that- upon investigation- are turning out to be corrupt and/or illegal on several levels. For example...
This latest @SDGE contract requires a 6-vote super majority to END the deal- not extend/approve it! This ties the hands of future Councilmembers in ways that the City Charter does not allow.
Also: San Diegans are still being charged the highest utility rates in California.
2/x
.@SDGE is making $1 million in profits every day on the backs of many of the lowest paid workers in the state.
Then there's the expensive city "lease" of 101 Ash Street- SDGE's former home
So please RSVP, join the discussion, and demand answers about these & other issues.
Inside the Capitol siege: How barricaded lawmakers and aides sounded urgent pleas for help as police lost control washingtonpost.com/politics/insid…
When I was Assembly presiding officer I worked closely w/our sergeant at arms. And when I introduced the bill to end Open Carry I had to travel with armed escorts to public events. There is no excuse for this type of breakdown of security in a professional law-enforcement body
This reminds me of an event in 2017 #ProudBoys began harassing attendees at an event in #SanDiego at the @SanDiegoCounty Admin Bldg. Deputies stood & watched so I called @SDSheriff Bill Gore on his cellphone & asked him: Why are your Deputies letting Proud Boys incite fights? 3/
3/ We've seen @LorenaSGonzalez draw the ire of corporations after #AB5 -> to Prop 22
We've also seen her conduct unprecedented campaign money laundering, transferring corporate funds to her husband- @SupFletcher - when he ran for Supervisor in 2018.
