Ok folks, to clarify, I RTed the German court decision because a couple of weeks ago I said on this here site that I would prefer a horizontal human rights standard to be applied when private platforms filter or remove user content,...
...rather than whatever arbitrary standard those sites choose to adopt that fits their political leanings, ability to resist political pressure and willingness to protect their users’ rights and stand up to vigilante mobs.
Know that there is still disagreement about this even between the German courts - hence me saying the decision wasn’t yet legally binding. Lets see what the Federal Court comes up with.
If you think that those that own the “marketplace of ideas” should have the right to exclude people from it just because they own it even if they exercised their FoE, then we disagree.
If you feel that the same platforms have no obligation to protect their users from clear human rights violations committed by other users, than we also disagree.
I personally believe that a generally accepted human rights standard developed and enforced by the courts is a pretty good one to employ, which is why, to me, horizontal application of that standard makes sense - at the very least when applied to platforms in a dominating role.
If anyone has a better idea, please write a blog. I’m going on holiday now. 😎🌞🥂
