My observation about the Kavanagh confirmation is that way a lot of people use “presumption of innocence” when talking about powerful white guys effectively means “presumption of impunity.”
Again and again and again in my mentions, the very notion that an accusation should be taken seriously is dismissed out of hand because of “presumption of innocence.”

There are a lot of problems with this. But there’s one huge one.
But presumption of innocence doesn’t protect you from accusation any case, nor investigation, nor public or private opinion.

It protects you from summary imprisonment without trial.

And that’s all.
Let’s set aside the fact that most rape and sexual assault isn’t even reported much less prosecuted much less convicted.

Set aside the fact that so far, if you are up for a SCOTUS seat and get accused your chances of approval are 100%
Set aside that it wasn’t a trial.

set aside the accused’s life was not ruined and never was going to be.

set aside the accuser’s life has been ruined and always is going to be.

Think about what they’re saying.
They’re saying that the offense is the accusation. The mere fact of accusation.

“Apparently now we live in a time where people can make accusations,” they say, which presupposes that once there was a time when people couldn’t make accusations, and that was better.
It’s an argument for immunity from accusation. It’s a presumption that a person should be beyond suspicion if they are white and male and powerful, that if you’re not you had better come with all your proof personally curated and neatly labeled and vacuum sealed from decades ago.
Don’t you find it strange, that the crime least reported also happens to be the crime the most people seem worried will be reported?

Almost what you’d expect to see if there were a bunch of people who thought they’d gotten away with something.

Like an underreported crime, say.
Mexicans are rapists
Gang members are animals
Assylum seekers are criminals
African countries are shitholes
Muslims are terrorists
Hillary is crooked
Journalists are enemies
Survivors are liars
The Central Park five should be executed

Brett Kavanagh is presumed innocent
Tamir Rice was a boy in a man’s body
Michael Brown stole cigars
Eric Garner sold loosies
Philando Castile moved too fast
Sandra Bland talked back
Botham Jean has pot in his apartment
Trayvon Martin attacked his stalker, says his stalker

Brett Kavanaugh is presumed innocent.
The protesters are paid.
The prosecutor is a witch hunter
The Democrats are a mob
The sex worker is a slut
Puerto Ricans died to make us look bad
Single mothers are tax thieves
If they have abortions they’re murderers.

Brett Kavanaugh is presumed innocent.
Remember, when you point your finger, there are three more pointing back at you, and also Brett Kavanaugh lied under oath and promised political vengeance and weepingly declared his love for beer, and he did that shit.
