The utility business model and power generation industry are built upon a century-old legal regime that does not contemplate DERs. At the state level, some legislatures have filled the gap in traditional public utility laws with demand response, net metering, and other programs.
Congress has been largely silent, so FERC is in the process of fitting DER sales into an 85 year old law. Thus far it has not attempted to directly regulate DER sales; rather, it is inviting aggregations of DERs to sell to RTOs (i.e. demand response rules)

This is utter nonsense. The only thing that matters is the federal revenue as a percentage of GDP. Deficits are determined far more by spending priorities than by tax rates alone.

Since 1950, federal tax revenues have remained close to 19.5% of GDP, no matter what the tax rates.
This is the thing no one in the media will bother to mention. Since 1950, U.S. top marginal tax rate has fluctuated between 28% and 91%. Yet the annual federal tax revenue has rarely deviated much from 19.5% of GDP. 1/
This is not entirely surprising. Higher tax rates don't increase tax revenue. They just force people to change their economic behavior in unproductive ways so as to optimize on their taxes. People just allocate their time and money in tax efficient but market distorting ways. 2/

Today, @RockyMtnInst released a new study on the economics of "clean energy portfolios" versus new gas plants. We find that gas loses, and it's a $350 billion and 10 GT CO2 prize for customers, investors, and the planet. Read on for more: 1/ rmi.org/insights/repor…
First, the situation: about half of the thermal capacity on the US grid is likely to retire by 2030. That represents a ~480 GW investment need for new capacity to replace it - and the default choice is new gas-fired capacity, which would cost ~$500B through 2030. 2/
Actually running those new CCGTs and CTs would cost another $400-500B, and emit 16 GT of CO2 through plant lifetimes. 3/
