The Trump admin was criticized for trying to deny kids the right to ask for asylum if they enter the US illegally, telling them to go to ports of entry. The issue then was Mexico was also blocking them from going through these border crossings vox.com/2018/11/20/181…

“Many questions remain unanswered, including how many children have died in CBP custody.”
An official with knowledge of Felipe’s death told me the 8 yr old had been detained by CBP for a whole week before he died. He and his father were detained since Dec. 18 after crossing into the US in El Paso, Texas.

Nielsen said unaccompanied children will be exempt from US plan to force asylum seekers along the southern border to remain in Mexico while their immigration case are processed.
"The goal is to protect those who seek asylum, it cannot be the way we do that is we force them to pay a smuggler trafficker and put themselves at risk," @SecNielsen.

As a fmr immigration attorney let me be unambiguously clear. Crossing a boarder to claim asylum is *not* a crime; no under US or international law. Any child separated from a parent under that pretext is done so in direct contravention to the laws of the USA. ⚖ THREAD Pls RT.
If you came to the US without permission to apply for asylum, youmetjod of entry, whether legal or illegal *should* in no way effect your application process. Illegal entry is not a ground of inadmissibility for asylum applicants.
Unlike many other categories of applicants for immigration benefits, ppl seeking asylum in the US are not barred by having made an illegal entry; for example, sneaked across the U.S. border or overstaying a valid visa (one of the top ways people are in the country illegall).

The separation of families is NOT according to law, but policy.

As a result, 1,500 children are lost, likely to Human trafficking.

The WH claims a 1997 settlement and a 2008 ACT, allows them to separate children from families. The settlement held that unaccompanied minors could only be held for 20 days before being released to families in the US, foster care, or shelters pending case resolution.
The William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 requires unaccompanied minors be placed in the care of the Office of Refugee Resettlement, or relatives in the U.S., while they go through removal proceedings.
