NEW: Democratic AGs have taken the first step towards challenging Friday night's order out of Texas declaring the entire Affordable Care Act invalid (see: buzzfeednews.com/article/paulmc…). They just filed papers asking for three things (thread coming): assets.documentcloud.org/documents/5634…
1. They've asked the judge to clarify that his order doesn't relieve anyone of complying with the ACA pending appeal, or that he formally stay any effect of his ruling. The judge didn't enter an injunction, so the thinking so far has been that his order doesn't do anything yet
2. They've asked the judge to enter a partial judgment (which the AGs could appeal), or else certify the case for an interlocutory appeal. My understanding from talking to lawyers who know more about appellate procedure than I do is that Friday's order on its own isn't appealable
3. They want the judge to act ASAP. They want a ruling by Dec. 21 on their other requests so that they can get moving on an appeal, since the judge held the whole ACA becomes invalid as of 1/1/19
