I asked the admin how they're making determinations regarding which fed employees to bring back to work and how that doesn't violate anti-deficiency act. OMB spox tells me they are "applying a meticulous and thoughtful process — on a case-by-case basis." Full statement below:
The Anti-Deficiency Act, btw, essentially bars the fed gov from accepting free services. During the shutdown, there have been q's raised about whether this is being violated and if politics is playing into admin's decision on which employees to bring back to work (without pay).
