Re: #Brexit legislation Stephen Barclay tells @LordsEUCom that in case of *deal* timing is “challenging”; prospects depend partly on parliamentarians' attitudes - does everyone accept that deal is happening & needs legislating for, rather than engaging in more guerrilla tactics
Talking about *deal* legislation, Stephen Barclay seems only to be referring to Withdrawal Agreement Bill - doesn't mention any other Bills;
Asked re: possibly using emergency powers to get legislation thru', Barclay refers to s22 of Constitutional Reform & Governance Act (CRaG Act). This allows ministers to exempt treaties from that Act’s ratification requirements.
While it is *extremely* interesting that Barclay refers umprompted to CRaG Act s22 (since, FWIW, I'd be unsurprised if it gets used in this case), it's nothing to do with getting legislation thru'

Ivan Rogers tells @LordsEUCom that chief negotiator for next round of negs w/ EU should be in No10/Cabinet Office. Shouldn't be DExEU. Bases view on Q of trust: chief negotiator has to be trusted across Whitehall, by all depts, & not seen as having dept'mental skin in the game
& now Ivan Rogers saying that knowledge of the EU in Whitehall became a "rarified art". But Brexit now forcing domestic civil servants to engage with EU more than they ever did before referendum.

if it helps people understand what's going on, one way I thought of thinking of it is that, on 29 Jan, one HoC majority voted for, say, 'blue'. And a different HoC maj voted for 'yellow'. Today's gov motion said 'green'. But there isn't a majority for that.
one of the oddities of the situation is that 'green' (in this analogy) - i.e. a position including *both* the Spelman anti-'no-deal' amendment *&* the Brady anti-backstop amendment - *is* the official view of the House: it's the resolution passed on 29 Jan....

OK, I've now read the transcript of today's debate & since the Constitutional Reform & Governance Act 2010 (CRaG Act) seems to have hit the headlines & there's a degree of confusion around, a thread just to clarify (I hope): 1/
The CRaG Act says that a treaty that needs ratifying must be laid before Parliament for 21 sitting days, without the House of Commons resolving against its ratification, before the gov may ratify it. 2/
The Act is primarily a vehicle to ensure the gov publishes, & tells Parliament about, treaties at least 21 sitting days before it ratifies them. 3/

1. There are two sides to the "rule out no deal" #Brexit debate - and both are wrong. There is no ruling out no deal. You can delay or revoke, but for as long as talks are in progress, no deal remains the default outcome unless a deal is agreed.
2. Parliament does not have the power to force the PM to ask for an extension. She is well within her rights to let the clock expire. Parliament can only take no deal off the table by voting for a deal.
3. The Brexiters, though, seem to think that no deal is leverage. It isn't. Brussels will not reopen the withdrawal agreement. Unless we extend for the 21 months, there is no chance of reframing negotiations. As far as they are concerned it is a non amendable instrument.

So. Tomorrow the House of Commons will vote on a series of possible amendments to Theresa May's 'Plan B' - or rather the 'plan of action to achieve a Plan B' - which itself officially reads as follows:
The amendment most likely to pass – and therefore the one on which most attention has been paid – is this one from Conservative party chairman Sir Graham Brady. It's effectively an instruction to go back and seek *some unstated other way* to avoid a hard border in Ireland:
Tonight, Theresa May has asked her backbenchers to vote in favour of this amendment. She is basically asking them to tie her hands, so that Brussels will clearly know what it would take to win the Commons' backing for any deal.

#Brexit thoughts this AM. The draft Withdrawal Agreement has a Northern Ireland sub-committee to the Joint Committee and sounds like there's been progress on an arbitration panel for the governance of the treaty = forum to discuss exit from a temporary customs arrangement? (1)
ANOTHER reminder of what @MichelBarnier said about the UK-wide customs idea way back in July. Note the problems he said had to be solved to make it work. europa.eu/rapid/press-re… (2)
