We argue that in case of no deal, our rights should be confirmed as a residual withdrawal agreement under Article 50. This is an unprecedented situation, Article 50 has never been applied before. If there is political will, a legal way can be found to do that.
We argue that until the UK make an official request to ring fence our rights, the EU27 will not move their position. The lives of British citizens living in the EU have been held in limbo for too long.

...firmly in the EU 27's court. By refusing to accept that CRs being outwith the existing mandate is an insurmountable road block, the PM would finally show that the rights of British citizens mattered to her during this process.
The only legal obstacle is the EU Negotiating Directive which says, "Nothing is agreed until everything is agreed." If the EU Council agrees to ring-fencing, all it has to do is amend its own Negotiating Directives. That is not much of an obstacle.
So why is the Prime Minister using this excuse not to make the request and passing the blame to the EU, instead of making the request and putting the ball in the EU's court?
