Wisconsin is obviously crucial in 2020. Tonight, we have a statewide Wisconsin race - a state supreme court race - as a bellweather.
Neubauer (Dem backed) has a small lead over Hagedorn, 38% in.

With 54% in, Neubauer (Dem aligned) has a 52-48 lead.
Wisconsin Supreme Court race:
Hagedorn (R-aligned) leads Neubauer (D-aligned) by 5000 votes with almost all precincts in.
If you’re looking for signs about 2020, this is not good news for Democrats. Dems barely defeated Scott Walker in 2018. Wisconsin is still toss-up.
Wisconsin race yesterday shows that conservatives are more mobilized compared to a year ago, and GOP increasing turnout outpaced the Dems. The race seems to tip WI court to GOP.
This is a big deal for state litigation over WI GOP power grabs and gerrymandering

In today’s @nytimesbooks, @DavidLat reviews @emilybazelon's important _Charged_ on prosecutors' upward political ambitions driving mass incarceration. They generously cite work by @JohnFPfaff (Locked In) and me. Here's a short thread w/ more detail. 1/ nytimes.com/2019/04/08/boo…
2/ In _Locked In_, @JohnFPfaff uses thorough research and rigorous quantitative methods to challenge conventional wisdom. He shows the chief cause of mass incarceration is the sharply increasing rates of prosecutors turning arrests into criminal charges (& then guilty pleas).
3/ @JohnFPfaff shows over the past generation, the ratio of prosecutions-to-arrests has roughly doubled, while arrests haven’t increased significantly.
That punitive turn in prosecutorial discretion drives mass incarceration far more than any other factor.
Why did that happen?...

If Trump's plan is to punish sanctuary cities w/ asylum seekers, welcome them. Don't litigate.
But what if his plan was to release undocumented people charged with violent crimes into sanctuary cities as political payback?
Surprise, look to the Roberts Sebelius decision. 10th A.
In Sebelius, a 7-2 majority found that the ACA impermissibly coerced the states to join the exchanges by threatening to take away fed funding.
Sanctuary cities aren't states, but cities are the creatures of states. Trump would be using threat of violence to coerce state policy.

2/ Please don't forget Engel's OLC memo approving the corrupt Whitaker appointment. It was riddled with flawed analysis and errors, large and small, because he rushed to validate Whitaker.
3/ Rosenstein is personally conflicted and compromised on obstruction. He was a main witness to the Comey firing and its corrupt intent. And he PARTICIPATED in that arguably criminal act.
Awfully convenient that he didn't find it criminal, apparently.

.#Wisconsin story. @JMilesColeman worked with @DecisionDeskHQ to break down this week’s state Supreme Court election. They will get to turnout next week. Democratic-backed candidate had won decisively in a race two years ago; maps here suggest what was different this time.
Context on the Neubauer-Hagedorn results above, by @BruceMurphyMKE. Points to @DanielBice for retweeting this, since one of Murphy’s arguments is that this campaign reflected diminished influence of @journalsentinel, Wisconsin’s largest newspaper.

Via @sbauerAP, it looks like former Scott Walker counsel Brian Hagedorn has pulled out a narrow victory in yesterday’s Supreme Court election. Subject to possible recount, Hagedorn benefited from margins in NE Wisconsin, weak turnout in Milwaukee County.

State action will be central in fighting gerrymandering. In NC, where the @CommonCause conference is happening, the state Supreme Court is about to become 6 D, 1 R. And the constitution protects viewpoint, equal protection of laws, free and fair elections - a basis for complaint.

... state legislation that mentions protection of people w/pre-existing medical conditions. There are some big loopholes, so @GovEvers responds by asking legislature to pass legislation to mandate in Wisconsin what ACA already does nationally, inc. on pre-existing conditions.
Incidentally: the rumor that Republicans in the legislature met with Evers the other day knowing he would mention Obamacare and expanding Medicare in Wisconsin, and therefore armed themselves beforehand with garlic and silver amulets, is probably not true.

The #WIpowergrab is so awful that it's literally keeping me up at night. The plans have been rumored for weeks, but the WI GOP waited until Friday afternoon to unveil their stack of bills, plans ONE hearing on Monday, and votes on Tuesday. So opposition is needed *now.*
In Wisconsin, right now, the GOP has total control: the governorship, both chambers of the state legislature, and a majority on the Supreme Court. That's one big reason why Trump won WI in 2016—because they'd rigged the rules. Now they want to prevent Dems from unrigging them.
