Rosenstein has a direct conflict of interest in avoiding a finding of obstruction because he participated in the obstructive act, Comey’s firing. Some folks are suggesting that we raised this post hoc, only after Rod made this call.

I was making this point in June 2018 in @Slate.
How can someone supervise the investigation in which he witnessed and actually participated in the key underlying act, which arguably was criminal?
Spare Rod, spoil the investigation.

3/ @DanielJHemel called on Rosenstein to recuse from the whole investigation in May 2017, 5 days after appointing Mueller.
I thought he could split off the obstruction case and keep the Russia case.
But Hemel & I agree on the core conflict problem.

In case you were waiting until Thursday to decide if Bill Barr is horrible, you can stop waiting. We have all the confirmation we need. "Barr’s order directed immigration judges to no longer allow some migrants who have sought asylum from posting bail."

As if you need more reason, here are some other reasons Bill Barr is horrible: He has a record of misleading Congress and the public to promote extreme executive power dating back to 1989. Maybe this White House knew all about this expert qualification:

As I told @CrisLeeMaza, “The legal standard is not actual conflict, it’s about the appearance of a conflict, appearance of bias."
A remarkable number of Russia-related ties raises concerns about Barr's judgment.

Barr earned $5K-$15K in dividends. Based on what sized investment?
Lorber brought Trump to Moscow in the 1990s, and he's tied to Trump Tower Moscow.

So maybe you're wondering if a cabinet member has ever been impeached... Here's a short history of impeaching department heads:
William Belknap, Secretary of War, impeached for kickback corruption, majority of Senate but not 2/3 voted to convict in 1876. He resigned anyway... 1/
2/ Attorney General Harry Daugherty was threatened with impeachment in 1922 for his DOJ's bootlegger kickback scandal. He was not impeached, but the investigation led to his resignation. I discussed this in a @washingtonpost op-ed on Whitaker this year: washingtonpost.com/opinions/think…
3/ Treasury Secretary Andrew Mellon - the famously wealthy tycoon - has supported the disastrous policies of trickle-down and fiscal austerity, and was blamed for meddling w/ the Fed to keep rates too low (!!!), and contributing to and exacerbating the Great Depression in 1929.

The transcript of say 2 of former FBI general counsel James Baker's congressional testimony is out. FBI lawyers told Baker not to disclose all the different ways Rod Rosenstein and Andy McCabe contemplated removing Trump from office after Comey's firing. dougcollins.house.gov/sites/dougcoll…
Baker testified that he does not actually know whether Deputy AG Rod Rosenstein eventually wore a wire as part of a scheme to remove the president of the United States from office. "I have not confirmed one way or the other whether it took place." Incredible exchange here.
According to Baker, Rosenstein and two cabinet members were "onboard with this concept" of using the 25th Amendment as part of a coup to remove the president from office. Baker said he did not know who the two cabinet members were.

President Trump has long borne a deep resentment over the recusal of AG Jeff Sessions, which many of us viewed as a necessary ethical step. The problem was not the recusal of Sessions but the fact that it was not immediately followed by the recusal of Deputy AG Rod Rosenstein.
The precarious ethical position of Rosenstein just became far more acute with a new report that he ignored demands within the Justice Department to remove himself in 2017.
