JUST IN: New documents from the government in Roger Stone case argue that Stone does NOT need to be guilty of an underlying crime to be found guilty of obstruction. Prosecutors say he mischaracterizes Bill Barr's pre-AG memo on this subject.
The letter from SCHIFF and NUNES transmitting Stone's testimony transcript to DOJ last December.
The government also indicates Stone's conduct related to his indictment arose form the same search warrant as the one that led tot he indictment of Russian hackers.
We even get a Marbury v. Madison reference (!) about why Stone is wrong about whether Mueller needed a "presidential commission."
The government also notes that it's not inherently wrong for the Justice Department to investigate a president, even though Stone argues that it would never be permissible.
The money quote from Mueller team against Stone: "To establish the defendant’s guilt of the crimes with which he is charged, the government is not required to prove the existence of a conspiracy with the Russian government to interfere in the U.S. presidential election."
One of the most interesting aspects of the special counsel’s filings against Stone last night is this elaboration on why a president can be investigated while in office. politico.com/story/2019/05/…
