NEW: @ICEgov accuses Montgomery County, Md. of releasing an undocumented immigrant accused of rape from jail despite a detainer on file.

Rodrigo Castro-Montejo allegedly raped an intoxicated woman last week. The 25yo Salvadoran national posted $1,000 for his release, docs show.
MORE: According to police, Castro-Montejo raped a female friend after a night of heavy drinking.

The victim texted Castro-Montejo from the hospital, asking if he stopped at touching or engaged in sexual intercourse.

"Oo a little bit of both to be honest," he allegedly replied.
MORE: This isn't the first case of its kind. In May 2017, ICE lambasted MoCo after the jail released an undocumented immigrant who brought an AR-15 assault-style rifle to Einstein H.S. in Kensington, Md.

MoCo later blamed the scandal on a clerical error.

STORY: Although relations between ICE and Montgomery County have been strained for years, they've hit a fever pitch under the leadership of Exec. Marc Elrich who was sworn into office in December.

Last month, Elrich said ICE's work parallels terrorism.

UPDATE: MoCo says it called ICE around 12p on August 13, using a phone number it had on file for a local ICE supervisor. That call reportedly went unanswered.

At 6p that same day, Castro-Montejo bonded out of jail. MoCo noted that it never received a return call from ICE.
MORE: ICE has verified MoCo did call one employee, an "off-duty officer" who was on “travel status" + "outside of the area" on the day of the incident.

ICE contends jailers should have contacted multiple officers and/or ICE’s 24/7 phone number before releasing an alleged rapist.
