1) He didn't have to file this at all, remember!
2) It doesn't make any difference he didn't ask for anybody but Funi to be dismissed because he can just ask at the hearing. WHEW!

7) A lot of the stuff the DEFENDANTS filed is frivolous and irrelevant, unlike the HellFiling, which is a lean, mean, probative machine.

8) Toei has almost certainly seen the filing and affadavits (aside: I doubt it, but they almost certainly WILL) and, hey, how knows, wouldn't it be funny if Toei cancelled Funi's license, he's just saying, nobody likes a hypocrite.

53) Vic's infidelity, inappropriate public behavior, etc, as alleged by Huber are totally not a problem because none of that stuff is illegal. Sure, it makes Vic look bad but fortunately public opinion of Vic is totally irrelevant to this whole shebang.

Brief diversion so Nick can explain what Gaslighting is. (Aside: he's actually defining it quite capably.)

Gaslighting can be funny but it can also be horrible, Nick wants you to know.

55) LawTwitter is making a big fuss over Huber's saying that Vic used his position to get sex. That's just rock and roll, my dudes. It's high school. It's being the captain of the football team. That's all. No big.

56) Monica and Jamie said that criminal charges were coming... but Nick's pretty sure that Jamie messaged somebody and said she didn't think the cops would be able to charge Vic, which is knowledge of falsity.

57) Nick's not SURE sure that the DM exists. But he's pretty sure. He's looking through his exhaustive database of Conclusive Evidence. Stand by.

62) Okay, it wasn't the best idea for Ty to notarize his own filed affidavits, Nick admits in the spirit of neutral review. Mainly because you don't want to be a witness about the docs in your own case, no other reasons really.

63) People have accused Ty of perjury and forging signatures and that's just crazy talk, especially from that crazy @greg_doucette

(Aside: If I understand correctluy, Ty's firm has been sanctioned for falsifying affidavits. Just sayin'.)

66) On to Slatosh's affidavit. But first some commiseration about missing a connection with a fan. Nothing but love for the Nicky Mouse Club. NOTHING BUT LOVE. Also, Nick likes whisky and bourbon, maybe mead, not beer. Just so you know. (Aside: I'm on his side, really.)

67) Slatosh had multiple voice and text conversations with Ron, Monica, and Jamie about Vic. Is Nick still lying about that, Ron? IS HE?

70) This affidavit will get the whole thing past TCPA OR THE LAW IS BROKEN, PERIOD. DONE, DONE, DONE, DONE. Monica and Ron knew. THEY KNEW.

73) That said, moving on to Vic's affidavit.

74) Which is clear and specific evidence of the falsity of the allegations. Let's be clear about that. Vic says he didn't do those things. So the allegations are clearly and specifically demonstrated to be FALSE. DONE.

75) Vic told Tammy Denbow that none of this was true, none of it, not a bit of it. Also, Vic can't help it that women come after him in droves. He can't. It just happens.

77) A LOT of cons cancelled Vic based on this malarkey, and he lost a metric tonne of money. (Aside: I believe that, at least the second part.)

78) All of the cancellers told him it was because he was accused of harassing up the countryside and Funi fired him and apparently that's not hearsay I'm not sure why MOVING ON.

79) I think Nick just referred to "Affidavit of Lying C**t" in reference to Monica but that could have been a glitch. I hope it was. Also, everything in this is irrelevant to the defamatory statements which is apparently good for Vic. (Aside: WUT?)

80) The story about Vic pulling hair and whispering in women's ears is common to all these defamers and is obviously part of their whisper campaign against Vic.

87) It's totally okay to file an amended petition with new evidence, it's totally timely, and if they added a count it would even DELAY THE TCPA AGAIN, they can do it, honest.

89) Texas allows you to amend your petition any time up to scheduling the trial, it's totally okay, it's not a problem, you can add new counts whenever you want, the defendant has to just suck it up. (Aside: I am not licensed in Texas. I find this, however, unlikely.)

90) Various readings from the Amended Petition, which apparently introduces all the evidence that... has been completely lacking up to now and without which the case fails, so that's good I guess?

91) Nick just did a Jim Backus voice which, to be honest, was not bad, although it's supposed to be a Glenn Beck voice, in which case it was terrible.

100) Nick wants you to notice what they're doing here: laying out the case clearly, point by point, which you know, this is a good time to do that, what with the petition and the response being filed and a dozen depositions taken and discovery made and the TCPA hearing in 4 days.
