The 9th Circuit has put a CA judge's revived nationwide injunction blocking the Trump admin's new asylum policy (see: buzzfeednews.com/article/hameda…) temporarily on hold while the court considers the govt's emergency motion for a longer stay — briefing to conclude Sept. 19
If you're feeling whiplash as this goes up and down in the courts, you're not alone — what this means is that, once again, there's only an injunction blocking the policy within the bounds of the 9th Circuit. We're also still waiting to see if SCOTUS will step in
DOJ submitted a letter to SCOTUS saying that now that the 9th Circuit temporarily stayed the latest nationwide injunction re: Trump's asylum policy, there's no need for SCOTUS to act on that, BUT they still want the justices to weigh in since the 9th Circuit injunction remains
